Neighbour clamped on his own drive

Our neighbour,has just been clamped on his own drive in his front garden for an unpaid parking fine some 6 months back.Just wondering if they are allowed to come on to your own propety to do this?

Council or Private?
Sounds like it's a council penalty ticket which has gone all the way to court and the council has got the bailiffs in.0 -

As I understand it proper bailiffs enforcing statutory penalties are allowed "peaceful entry" to property.
In extremis this means they could legally climb through an open window into your house ..so walking onto a drive is likely to be well within their rights. (Provided they have the correct documentation allowing enforcement with them)0 -

Only if it's a Council ticket which has gone the whole way without him bothering to appeal it properly.
Most Council PCNs can be overturned, if only people got good advice from pepipoo forum they could avoid this hassle.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Now the bailiff has the clamp on they have the upper hand. However they have to follow certain rules and your best bet to see if they have done it all correctly is to go to Bailiffadvice online.
It needs dealing with as every-time the bailiff turns up, or if they remove the car its costing more.
It wont help your neighbour but I find it hard to understand how people let tickets get to this stage? We have seen £50 tickets ending up at several hundred pounds!0 -
Can't comment on the specifics of this case with no details but in broad details, of course bailiffs are allowed peaceful entry to a property to seize goods and/or execute a warrant, the whole point of bailiff action is that its a court mandated method for one person to recover a debt from another who has ignored other more reasonable attempts to get the debt paid.If you don't stand for something, you'll fall for anything0
