I wasn't the driver

Help please!

I received a parking charge from Parking Eye, and I wasn't the driver so used the website template letter to inform them of this. As expected, more correspondence has followed...both dated the same day: another parking charge demand, and a letter telling me I have to tell them who the driver was or pay, and they're quoting a case in Oldham where a case was won against an owner who said he wasn't the driver but wouldn't name the driver (as I have refused).
In hindsight, I shouldn't have replied but I have so any advice please on what to do next? Thankyou!

Just ignore them? Laugh at the silly letters that get ever more 'threatening' - then they stop coming!

What ???????????????? They are still quoting the Thomas case from 2008 ? They are idiots ignore them.
In the case they quote there was evidence that the keeper Stephen Thomas was the driver..so he had to pay as the driver.
He was NOT forced to pay because he would not name the driver.
His case has no relevance to yours..ignore these morons.

County Court Judgements do not set any legal precedents.
Doesn't it strike you odd that they have to rely on this one case from 2008 ..there have been no others since ....?
Why ? Because Thomas was either an idiot who implicated himself or a set up ..that's why.
You don't have to do anything except ignore these idiots ..which is what you should have done in the first place.

    IGNORE ALL FUTURE LETTERS.

That Oldham case (which took place three years ago) was a one -off. The guy denied being to driver to the parking company even though he had boasted several times on an internet forum that he actually was driving. The judge looked unkindly on that and found against him.

Parking Eye are getting desperate if they can only rely on such a very old case. They somehow forget the cases where PPCs have lost in court. Some of these happened very recently.

Shouldn't have bothered with the template letter as it has no effect except to fan the flames of their con and generate that extra letter you received!

Now they will revert to the usual letter-chain for Parking Eye, please revert to ignoring them. Parking Eye have never done Court - although they threatened it there's never been a case - except for the one they lost when they were taken to Court for a refund by a solicitor.

Parking Eye are a scumbag PPC like all the rest, it's just a money-making scheme and nothing will happen. Ignoring it is like ignoring a series of phishing emails, no effect on credit rating obviously as it's a scam.

  • Thank you to all who have replied - I did notice they were quoting an old case at me, but a bit of reassurance was needed from people with experience of dealing with these companies! Am going to ignore them from now on :T

Its best to ignore them. They write complete rubbish.

I once challenged them to provide me with any legislation to show I had to inform them who was driving. They replied there isn't any but I have a moral duty to inform them. Parking Eye and morals don't knit too well!!

My next letter was foxtrot oscar or see you in court!! As Diana Ross sang "I'm still waiting"

In the Oldham case he WAS the driver. County court sets no precedent anyway.

So if you were not the driver, you have nothing to worry about.
