    13/ Engaging in a commercial practice which was a misleading action contrary to Regulation 9 of the Consumer Protection from Unfair Trading Regulations 2008

    Sentence = Absolute discharge!

    The problem with this sort of case as with financial fraud cases, the average juror would be hard pressed to understand the technicalities of the charges. The burden of proof being absolute on the prosecution. If the whole jury could not understand the charges they will no doubt find the accused not guilty.
    Given the Judge's sentence of an absolute discharge, he/she probably thought the one guilty verdict was harsh?

    We have no visibility of the facts in evidence or of the arguments used.
    All else is speculation.

    However guilty is guilty no matter the sentence.
