Can't wait to see the outcome, hope Hull TS have prepared their evidence well.

If this gets the right result of a conviction we can quote it at our MPs and our local TS, along with the VCS tax-avoidance attempt and ask in what way do they actually think that ANY PPC's business model is any different? Could be a nice nail in the coffin of Schedule 4 at least, maybe even PPC World if we use it well.

On a similar note, I sent off a fairly long email today to the BPA asking them to comment on my contention that many PPCs set out to fool people into thinking that they are dealing with official organisations instead of powerless private companies.

This deception is multi-layered. It starts with the names of the companies. They are peppered with such words as "agency" "enforcement" and "national" . Not forgetting the infamous DCEs going by the names of "Judges Demand" and "Court Proceedings Ltd". It then moves on to the parking tickets with liberal use of yellow and black borders, calling them PCNs and including the warning about not removing the tickets.

The final layer is the follow-up paperwork with some companies using the "scales of justice" logo, the threat of Bailliffs and CCJs and threatening to blacken people's credit history.

I am not holding my breath waiting for a reply from them. But it would be polite of them if they do come back to me.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?

Should have copied in your MP I find it sometimes prompts a reply if you copy in others!

    "Dear Mr Tristonata,

Please could you supply us with the details of your parking contravention, including the name of the company who issued the ticket, the date and registration no. of your vehicle.

If it is one of our Members, we will confirm that their correspondence conforms to the BPA Code of Practice, and then forward your details so that our Member can consider your appeal.

    Yours sincerely,
    British Parking Association"

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

I recommend a quick read of the first post in the Pepipoo thread mentioned above - particularly the last paragraph.

One wouldn't want the proceedings endangered as a result of any comment that could be interpreted as incautious or worse. The trial was originally listed for 3 days and there is no reason to believe that it will run beyond that as yet.

Hopefully a full report will be available at the end of the case. At most any report at this stage will simply enumerate the defendants, the terms of the indictment and summarise any evidence heard to date.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

Entirely correct, once the case has concluded, and judgment delivered the details can be published, until then we must wait.

I can't help but feel that this self gagging is somewhat over cautious ..but unless anyone else cares to pop along it seems we will wait for a final outcome.

Court proceedings are public ..as such unless the judge makes a reporting restriction anyone can report on those proceedings....

I agree that commentary, opinions and interpretations could be unhelpful..but brief factual statements could be posted.

Caution may be prudent but that does not change the principle that trials are meant to be public.
