    If they're registered in Spain then AFAIK a small claim will have little chance of success :(
    I would be using the travel insurance or credit card S75 cover instead IMHO


    Iberia and BA are now the same and go under the name International Airlines Group (IAG) and whilst registered in Spain the head office is in London.

    Even so, as a EU country and a signatory of the above regulation, they would not be able to escape litigation simply by the fact they are in a different country.

  • Had one last roll of the dice today- spoke to their Hammersmith office in London (just back office functions), the customer relation department (who are now telling me that they do not have a customer relations team and that all complaints must be made online!), and even tried BA.

    Not received any response to any of the last online complaints made in the last 6 weeks.

    Therefore sent the letter before action today, giving Iberia 14 days to respond. I suspect it's inevitable that I'll have to raise a small cost in 2 weeks time. What a drag. :(

    Oh, also sent to BBC Watchdog to see what they make it of.

    I wonder if this is standard avoidance tactics by airlines cs departments?
    I had a similar issue a few years ago and was told by the airline cs that they had never heard of the eu regulations! It took numerous letters,eventually I was offered vouchers which I sold on ebay.
