Can LA Fitness cancel a membership offer once it's started?

I cancelled my LA Fitness membership a few months ago having been a member for several years.
2 months ago I received a text on my mobile phone from them offering me to rejoin for £31.49 per month. I called and found out there was also a £35 're-joining fee'. I told the manager there that if they waived the rejoining fee and did it for £30 a month I would rejoin. He said yes, if I signed a 12 month contract.
So I rejoined and they took the first payment out of my bank account. In the second month I arrived at the club and my card did not work.
I spoke to the manager and he said Head Office had cancelled my contract because the membership price I was paying should only be available to corporate members. He said they can cancel a contract for whatever reason whenever they like. He then offered me a new price of £38 per month for single club membership as opposed to multi, which is what I had. I said no and that was that. They didn't want me!
I want to know if it is legal for them to rescind an offer price once the contract has started and the first payment has been made?
I am also baffled that they would rather have me leave the club and pay nothing, joining one of their rivals, rather than get £30 a month from me for 12 months, when £30 is clearly not their bottom line and is what they charge corporate members. Bizarre business sense or lack of it.

Does it have any clause in your contract about them cancelling the contract?
If not then no they cannot. If they refuse you entry they could be deemed to be in breach of contract by failing to provide the service you both have agreed to. Send them a letter by registered post giving them the opportunity to make their breach right again.
Personally I would demand they refund the first months fee and move on. Leaving many negative reviews in the meantime.0 -
it does sound a little strange that they'd let you walk out of the door and wave goodbye to £330 for the next 11 months and see you go elsewhere rather than writing off the mistake. they've tried to make an extra £88 but now at the cost of £330
