new here and scared, had threatening letter from solicitors

hi everyone,

as the title suggets, i am new here but extremely scared. I started on a DMP in October last year. This morning i have had a letter from a solicitor who act for Capquest. Basically they have given me until friday to pay £933.55 that i owe to one of my creditors. Obviously i cannot afford to pay it. If i dont pay it they said they will either 1. Start legal proceedings immediately and will add £150 of costs onto the above amount or 2. They will send someone round to the property to establish details regarding my personal circumstances and to ascertain if i have any assets on which to levy. I live in rented accomodation with my partner and son, the only thing i do own is my car. This isnt worth a great deal, its an S reg peugeot 106. Everything is in my partners name.

I am so scared, i dont want to go to court, i dont want people knocking on my door (im already on anti depressants for depression and anxiety), i am scared for my son and i cant afford to pay them anymore thn they are getting from my DMP.

I have rang CCCS and all they told me to do is ring the creditor and ask why they have sent the letter - even though its from a solicitor.

I am a nervous wreck, any advise would be much appreciated, i am seriously going out of my head with worry.

    Firstly - don't panic. Capquest are an evil company, largely staffed by jobsworths. There are many discussions on this board of their underhand, miserable and sneaky scare tactics.

    People who have much more experience of dealing with them than me will be along to help you shortly. So go and get a cup of tea and come back, by then the experts will have arrived.

    They cannot take money you do not have and they cannot enter your property without your permission so do not answer the door to them.

    Do you feel up to ringing Capquest? If not (and that is perfectly understandable) then we will work out another to sort them out.

    Your health and your family must be your priorities. Take care.

    firstly its unlikely to be from a solicitor...its probably simply titled that to frighten you.

    secondly a letter from a solicitor is absolutely no different from one from you or me. it has no status in law and anyway there's no way they are actually going to pay a solicitor to write that letter.

    thirdly if you read around this bulletin board you will see this situation is happening all the time.. especially with Capquest.

    basically they know that by writing to people with these scare tactics, many people will be panicked into paying money that they can't really afford.
    I'm afraid in the early stages of a DMP this happens a lot.

    its fairly unlikely that anyone will come to your property but if they do simply send them away. they are not baliffs and absolutely no legal powers whatsoever. if they refuse to leave (most unlikely because they know they have no powers), simply call the police.

    Simply stick to the simple facts...you are dealing with your debts through CCCS, quote your number and tell them to deal with CCCS. Do not discuss payment with them and do not agree to change your payments in any way.

    They can of course take legal action, as can all your other creditors. If they do (unlikely) you will receive a summons from the court. you will be able to tell the court that you are paying through CCCS and its most likely the court will agree to that figure (which is why its unlikely they will actually summons you.)
  • Capquest seem to be doing their books at the moment and want to call in on all debts. If you phone the number on the letter I'd bet you get through to crapquest rather than any solicitor.

  • hi and thank you for your replies, i am feeling a little better now. My partner is an avid reader of this board and told me what you guys had said but i didnt believe him so he told me to post for myself!!

    I am not up to ringing capquest :( CCCS told me to ring my creditor and ask why i have the letter but i am not upto ringing them either :( useles i know but i burst into tears when i rang CCCS this lunchtime!

    Do i just ignore the letter then?

    Would you feel better writing to them instead? I bet there's a letter template somewhere that says 'I'm on a DMP--leave me alone!' in a business-like way.

    I started a thread " Warning CapQuest" yesterday its currently on P6 Of this forum!

    Advice, type in Google CapQuest Debt Recovery. When it comes up with the pages scroll down. The 2nd one you will find Grumbletext a small forum specifically for people like yourself, with help to sort CapQuest out!

  • just an update...

    i have written to capquest (or crapquest as you guys so rightly call them) lol :rotfl: basically telling them i am cccs so they can f off basically. it was sent recorded yesterday so hopefully they will get that today. I am dreading next week incase i get people knocking on my door. i am nervous enough as it is without this adding to it!

    Reading these posts on here, it really seems like they are chasing a lot of people at the moment. Do they really enjoy scaring people like this?

    Will let you know when i get the so called "agents" knocking on my door.

    Still worried, but thanks for your help on this matter! love the boards!

    if anyone does knock on your door refuse to let them in, no matter what they say, Do you have one of those security chains on your door, if so always keep it on when you answer the door to anyone. It will give you a bit of peace of mind because you know they can't just push their way in (I doubt they would try anyway) Then close the door on them and let them talk to you through the letterbox, they look like right idiots talking to a closed door ;)

    I really doubt it will come to that though lol
  • Just a quick note, I had something similar at the end of last year, not with Capquest though.

    We first got a letter from a solicitor, saying that they had been asked by their client to contact us & give us 30 days to make full payment or they would take us to court.

    I phoned them & asked them where I was expected to get the money from & asked if I should go sell myself on the streets, he said, not his problem how I got the money :eek: lol

    Anyway, I wrote a letter, basically saying, we were in a DMP, we were paying what we could & that they should feel free to take us to court as the court were likely to accept our offer of payment.

    A month went by & we received a letter saying that someone was coming to the house to talk to us about how we plan to pay, I panicked a bit then, but wrote another letter requesting that they correspond via post only.(they didnt turn up)

    Another few weeks went by & at the beginning of December we received notice from the small claims court, saying that they were taking us to court.

    The court forms had a section where you fill in a SOA, so I did this & returned it to them with a letter saying, we are doing all we can, we are commited to repaying the debt etc etc.

    We've now received notice that they have finally accepted our reduced monthly payment :T

    I think, all of it was just scare tactics, trying to force us to take out extra debts, borrow from family etc to pay them quicker.

    phew, this is a bit long, sorry. But I thought it might put your mind at rest a little
