Help......

I got two parking tickets.
The car is in my ex name and I drive the car.
I got the parking tickets, appealed when they went to my ex address, they wouldn't respond as I as the registered driver and tickets went up.
The letters went back to my ex and I got them when the company equita had taken over the debt.
Tickets have at this stage now gone up to 100 each. I called equita to pay and they told me that they had that day passed it to a road baliff.
Called him and gave him both the ref numbers and he said the fee was now 344. I wasn't happy but said I would pay it as didn't want him going round to my ex house and he said he hadn't gone round their yet and if I paid it now, it would be clear. I asked him for a break down of charges and he said he couldn't do that but that the company would.I paid the 344 that day. I called and asked them and they informed me that they couldn't discuss this with me as I wasn't the registered owner of the car. So asked my ex to call them. They said he had to write in. Did. Still no break down. A couple of weeks later, my ex went mad and said a bailiff letter had been put through his door and why hadn't I paid the bill. I called the company and they gave my the bailiff number. I reminders him that I had already paid this debt a few weeks ago and he then informed me that that was for one ticket and had to pay 344 for the other! I asked for a break down and again he wouldn't give it. I paid the 344. I asked for a break down of charges again and my ex had to write in. I just a letter via my ex, with the charges and it states that visits had been made before the first letter tat equita had wrote to my ex? I have asked the company to look into this and I have been charged for visits that were not made. I made the payment for the first ticket before the bailiff had even been their.the dates on the letter and all wrong. I have heard nothing from equita and I has been 4 weeks. So I have just filled a form 4, which my ex has completed and signed. Does anyone know what I should do next. Does the court refund you for overcharges. WhT else can I do.

    Were these tickets form the council or private parking companies.

    Has the matter been to court, there is no mention of this in your post.

    Why on earth haven't you reregistered the car to you? Is it properly insured?

  • It must have gone to court.. But I just got a letter from my ex fro equita, I had been writing to the council to appeal but responses went to my ex as he is registered owner

    Which insurer has allowed you to insure a car you have no legal ownership of?

    You should be the registered keeper of the car regardless of ownership. This scenario is why!

    Never heard of that Borough Council but at least we know they are real PCNs rather than scam ones from a private company.

    So I would advise you to go to bailiffadviceonline, join/register and pay a tenner for their expert advice. Sheila the bailiff adviser on there can help you and it will almost certainly be worth the tenner if she can get a hefty refund for you. Thing is your ex may have to be involved as he is the registered keeper, so although you paid he may have to do the paperwork as advised by Sheila on bailiffadviceonline.

    I have no connection with that website BTW, on this forum we do always advise people in your position that they are the expert website and have never had bad feedback, only good.

    And next time if you get a real PCN from a Council, for goodness sake go to pepipoo forums or here and ask for advice on appealing properly and winning, and make sure your ex actually replies to the Council letters. Or change the 'registered keeper' to your name or this could happen again.

    There is no such thing as a registered driver.
    The person appearing to be the owner is liable. This is taken to be the RK unless rebutted.
    From the above posts the ex is the RK and is liable and there is no reason under the regulations why you should have paid.
    Add to this that the bailiffs may well have located the vehicle and distrained there - which is wrong.

    Sheila is by far your best bet I believe.
    May I suggest that you organise all the facts in a coherent time line list before you call, that will help to expedite matters.
