stop claim court against LL

Hi,

I have submitted a claim court against my LLS for deposit back but I did mistakes , and now I want to stop it and start a new and correct one.

I want help plz on how to stop a claim

  • You can ask the court staff for procedural advice in theory, although they aren't always very helpful. When you approach them, say you are asking about a procedural matter right away, that's less likely to make them defensive (as they are always getting asked about stuff they can't legally advise on).

    Good advice though my experience has been that they are very helpful!
  • Maybe they are, my only experience has been people complaining on forums but perhaps they were asking legal rather than procedural questions.

    Quite likely. I've always made clear I don't want legal advice, just administrative/procedurel.

    Same with the Land Registry: very helpful telling you how things work/what forms to use /even how to complete forms, but they clam up fast if you ask for legal advice.

    And HMRC now I come to think of it!

    Notify the defendant that you are withdrawing the claim. Write to the court saying you are withdrawing the claim and have notified the defendant.

    Phone the court after a couple of days to check that they received your letter as courts are notorious for losing paperwork.

    thank you all for replies and advices

    I will try to call the court tomorrow and hope they will answer because they never do , if they dont answer I think I will follow what may-fair say : send notification letters to defendants saying thay I am withdrawing the claim , and send a letter to the court asking to stop or withdraw the claim because of errors and mistakes + copies of the notification letters sent to the defendants and wait until I recieve a confirmation that the claim is stoped and then I start and take a new one

    my questions :

    - are these steps correct ?

    - should I send the notification letters to the defendants 1class standard or recorded ?

    - for the request of stoping the claim should I whrite a letter by hand or there is a special form to fill for this request ?

    I found that to amend a served claim a bit complicated and still have to pay a fee :(

    I just spoke to the court and the officer told me that to stop a claim I just have to write a letter asking the court to stop the claim with the reason , and that I dont need to notifay the defendants only if I wish to but I dont have to.
    so now I will write the letter and send it today to the court
