Can anyone help - cyclist hits car - advice please

    As previously posted you misunderstand (or choose to).

    Not admitting liability is something quite different to lying!

    If anyone asks you to admit liability, simply tell them "you know I cannot do that - leave it to the insurers"

    I still disagree but don't want to end up in a slanging ? (correct spelling? ) match

    I still can't see where the argument is when someone damages my car for example when it's parked on my drive and I am not in it and they don't or can't admit liability

    if they slid on black ice , they we're going to fast for the conditions ( obviously there was frost around )

    heart attack ,ok that may well be bad luck ,but they were still driving the vehicle that caused the damage and as far as I can see still liable



    still can't get my head around this "don't admit liability " even though it may well have been me that rammed a car up the rear at the traffic lights when that car was already stopped

    I would still expect myself to admit it was my fault

    I say again no wonder insurance costs are so rediculous now
  • We all want to save money but the neighbour has been inconvenienced by having the car damaged. The least the parent should do is to pay for the damage without putting the neighbour through the stress and expense of an insurance claim. Consideration for other people should come before saving money. I'm not having a go at the OP because I realise the OP wants to explore all options but I think losing the car for 3 days whilst it's in the garage is more than enough inconvenience for the neighbour.

    Hi,

    As has also been said in these forums many times, the insured person will probably have a clause in his insurance policy saying that he must inform the insurance company if the car is involved in an accident.

    Not doing so, could be cheap in the short term but extremely costly in the long term.

    highly unlikely if it's a kid on a bike. If the car owner doesn't tell his insurance company how are you expecting them to ever find out?
    You may have a clause in your policy but you don't have clause in common sense.

    It is only a low risk in probability terms, as you say. Remember that the OP was keen on being honest though? They would therefore encourage the car owner to contact their insurer.

    I'm guessing the only risk of being found out is if the garage the car is repaired at is one used by the insurer as an authorised repairer or if the kid's parents try contacting their own home insurer etc..

    Thank you all so much for your help and comments - sorry to have stirred up some extra *discussions* !

    I read the other threads directed, and was a bit disheartened by some of the bickering tbh.

    In the end we wanted to put it to bed quickly - the (it was the neighbour's boyfriend, not actually neighbour it turns out) guy went straight to his dealer and they told him it could invalidate his anti-corrosion warranty if it was repaired elsewhere, so we agreed to the quote which was considerably less than I'd feared thankfully.

    I phoned the garage to pay so he could book it in and explained the situation to the lovely lady on bookings there, and she was so sweet she gave him a free courtesey car (it was going to be over £100 on top!) because she said it was nice I was so honest. So that's a good thing, and saved us a bit. It cost nearly £850, but it is sorted quickly and I so hope there will be no hard feelings, it was a genuine accident and at least my son was not hurt (except his pride I think, and his ears after his dad and I spent the weekend on at him to be more careful!!). And he is banned from riding his bike in the street when there are cars there (most of the time unfortunately).

    I don't think I could have held my head up in the street if we had tried to mess him around, so I have kept most of my self respect in tact. And hopefully it won't be the subject of neighbourhood gossip, even though it cost us an arm but not a leg, I do feel glad it's out of the way.

  • £850????? how big was the scratch? You could have got a full blow over for that price.
    I think the free courtesy car was because they'd had a field day with the cost and the anti corrosion warranty was probably a bit of a lie.
