Have just been to a tribunal in Reading Berkshire, The VoA is claiming that because we did not claim unfair banding within 6 months of moving into our house in 1995 we cannot be rebanded. We were not the only people there and everyone had the same letters. If that is the case how are so many people getting money back???
tasilow. The 6 month rule is the standard letter if you are over that time. However the voa have to maintain an accurate list and you'll have to try and prove that your banding is wrong by looking at archived library house prices etc etc. Have a look at the council tax discussion thread there's loads of good advice and information on there.
All is not lost but you'll have to work at it.

To those of you who have received large sums in backdated Council Tax - when did you apply for it?
The reason i ask is that my council have told me I'm beyond the 6month limit and after i disagreed with their decision (on the banding, not the time limit - it was 7months) it has gone to the secretary of the valuation panel.
The point is, if you all have received hundreds and sometimes thousands in refunded tax, then you've been in the wrong band for years. How come you are all being paid out and I've been told that my appeal is invalid?
Is it normal and I should just wait for the next step or is there something i should be prepared for??

Shows it is not so easy for some.
It's good to see some of the success stories from MSE's who originally asked for advice on the council tax 'discussion' thread.
Anyone not sure what to do next for a review look at the discussion thread.

well i have to say i have just been successful..and have been informed today
.i lived in the property for 3 years before appealing 3 months ago.I wasnt aware there was a 6 month rule until i read these threads tonight.
dont give in!no longer spending a pound to save a penny!0 -
Followed your advice to the letter and after several e-mails and phone calls achieved re-banding form C to B by South Ribble Council.
Backdated to 1993, am about to receive refund of around £1400, and monthly Council Tax down by about £25

effective date of rebanding April 1st 1993 so going for refund now.

Amount refunded: £1,138.96
Annual saving going forward: £300 ish
Phoned local valuation office after following advice on this site and discovering both neighbours were in a lower band than us despite the houses being the same. They sent someone round to look and a few weeks later confirmed that they were changing the banding from F to E. Easy. I spoke to Sefton Council the same week and received a cheque today - four weeks after the Valuation Office sent the letter. Brilliant. Thanks to Martin and this marvellous site for help and advice.0 -
Have just heard from local Council that we are due £1,400 back due to over paid poll tax since 1993. Thank you for the program. Taken several months but got there in the end. Neighbours now following up. Members of family did not think I would get anywhere! Very happy. Council is New Town status in West Sussex
saving of approx £15.00 a month now.0 -

Took me for months of phone calls every week to get a result. Not bad considering we have only been here 2 years. Have now told my neighbour upstairs and he is reclaiming his. Thanks Martin0 -

Have received an offer to reduce band but also a refusal to compensation as my proposal was invalid because it was not made within the period laid down by statute.
I have four weeks to appeal does anyone have successful claims against GCC as I have basically been overcharged for over twelve years.0
