  • I applied for a council tax banding reassessment over the phone. I have received notification today that my property has been rebanded from a Band C to a band B and that i will be receiveing a cheque for £1200.00 within the next three weeks. Not bad for the price of a phone call!
    Thank you Martin :j

Bronking do you have any extra information you can share with those of us on the chat discussion thread who are having a difficult time with rebanding and voa?

    Any extra info might help.

    Thanks. Maisie
  • Many many thanks to Martin. I appealed to the valuation office sending the surveyors report and have had our band reduced from E to D. What's more Horsham Council have now refunded nearly £2,000 dating back to when we moved in here in 1999. BRILLIANT.

Local Council: Rushcliffe Borough Council Nottingham

    Council Tax Band Before: F
    Council Tax Band After: E
    Amount refunded: £2952.16

Back in 2004 I had appealed against my council tax banding as I knew I was should have been in band E, however I never actually received a definite answer after a verble that my banding would not be changed. After following all the tips and advise given from ITV's Tonight and gathering as much information as I could from the links given on moneysavingexpert.com I have eventually been successful and recieved a refund of £2952.16.

Advise is not to give up, as I did originally. keep fighting and good luck to everyone else.

I have been told that because I have been in my house for over 6 months, I am not entitled to a re-evalutation (St Albans District) - When I spoke to my local VOA office, they have said that they will look into it as I was not informed of this banding when I bought the house and as I was a first time buyer, how was I to know these things? Think that solicitors should inform buyers of this. Am waiting for a response now - will probably be 4-6 weeks. Will keep you posted
You can apply for a revaluation what you can not do it ask to go to a tribunal after you have been living in the property for 6 months. However is you ask for a revaluation and they say there word is final you can go to your local onwardsman who has the power to look into this for you. Phone you local tribunal office and they will give you all the details of what to do if you are still not happy. Althopugh they can not look into the decision they can tell you what you can do next regarding the onwardsman.

    Best of luck.

    THANKS A MILLION MARTIN

Have followed Martin's advice & checked my banding only to find that I was the only property in my cul-de-sac on a C band all the others were A. I applied about 6wks ago for rebanding and was informed my application was going to a tribunal and not to expect to hear anything for 6mths. I have today been notified that I have been rebanded to A. Rang my local council to enquire about refund and was told it would be processed automatically - great result as I've lived here since 1975. Can't thank Martin enough.
Just heard I am being refunded £2,495.00 - great result.

The lovely lady Listings Officer at Colchester has told me that the only way that I can appeal against my tax banding, is if it was within 6 months of the original valuation. This was 13 1/2 years ago in April, 1994, so naturally, I had no chance of a revaluation, asking for it now. I told her that I realised that I could not appeal under this rule, but wished to appeal, under the auspices that "Every Tax Collecting Council has an obligation to ensure that every Council tax assessment for each property is correct". When I phoned, I was informed that this "bloke", (Martin), on the Tv, had got it all wrong, and as far as she (the Listing Officers representative), was concerned, there was no way that I could appeal against my original assessmement, as I was out of time. I tried to explain that my reasons for my appeal was NOT in respect of time, as I was FULLY AWARE that I was 13 1/2 years late in my application, but I definitely got the impression that it was "Sod you, we are right". They even sent me a form to sign and return, cancelling my right of appeal, and recommended that I sign it. Needless to say, I am now going through the appeals tribunal. The Colchester Office still maintain, that there is no right of appeal, unless it is made within 6 months of assessment. They will not entertain any other reasons for appeal, and will inform you that there are no ways that you can appeal. Even if you appeal against this, their answer is, "Your appeal will only be considered in respect of the time limit of 6months, any appeal after that date will automatically be deleted". So, as far as the Colchester office is concerned, if you are not within 6 months, don't even bother to try, as the time limit is the only faction that they will entertain, and of course, very few are within this limit. However, I am going to try Martin's ploy of appealing anyway through the tribunal, and Sod 'em!!! Colchester office would have you believe that there is no right of appeal to any body or any organisation, once they have made a decision, and that is the end of the matter. They now want me to send them plans of my bungalow, and the plans of others nearby, to assist them in their opinions!!! Cheers, Woodville.
