Carphone Warehouse Phone Insurance refund?

My mum took out a phone contract in 2002 with the Carphone Warehouse. They asked her at the time if she would like phone insurance and she said yes.

When she cancelled the contract a few years later she assumed that all payments to do with that phone would stop. Only now has she realized that she has been paying just over £100 a year via Standing Order for phone insurance on a phone she no longer has. Obviously this means insurance on the phone was a separate contract with the company but she did not realize this.

Now I know we probably don't have a leg to stand on but is there any particular wording we can use to get a partial refund for all the years that carphone warehouse has been insuring a (probably now non existent) phone. Seeing as the phone may longer exist they are providing a useless service.

If it makes any difference carephone warehouse also seem to be struggling to find this contract that was signed as it was so long ago, might this help our case if they cannot find the document that was signed?

Cannot belive me mum has not checked her bank statments for the past 6 or so years :mad:
