Mis-sold an ISA - Who do I complain to?

  • Yes I did complete that 8 A4 sides of profiling. BTW, at the time, 1% was the cheapest commission for a high street investment ISA. Perhaps there is something cheaper on the Internet, but I don't know it it doesn't matter in this case.

    Anyway, when I spoke to SW, they asked who the family member was and requested their employee no. Me being a male (with a masculine voice) and telling them my mother was the staff employee, one would assume that I wasn't the staff member - but who knows - maybe they weren't that switched on.

    The new financial advisor at the branch has told my mum that the tied rep who dealt with me blatantly cocked it up and SW can't be asked to correct it. This is a complete shambles and totally unprofessional.

    I did phone them to express my disappointment in this whole case and the person the other end of the phone went so far in saying its a matter between me and the tied rep (!). I asked to log a compliant and she said she'd pass my details to the complaints department. Still waiting to hear back, but I am not holding my breath and therefore wanted to escalate in another manner (hence original post).

    I do not think we have sufficient info to state it is the OPs error? It is not clear from OPs post if the staff discount was discussed with the rep? Certainly as a family friend he would have known his mum worked for SW and ought to have known if OP was or was not entitled to a discount and filled in the form accordingly. Perhaps OP ought to have checked it more carefully but SW can be held accountable for a failure of their ex employee, if it happened as OP said.

    I am aware of the FOS system, I gave the OP reference to their web site where he will see "... give the firm a chance to put things right..." . The first step is to write a letter to SW clearly marked "COMPLAINT". Then write to FOS rather than waiting until he has exhausted the lengthly complaints procedure. If he copies his letter to SW it may encourage them to take his complaint seriously and speed up the process.

    In my case I gave NW a chance to put things right... but I did not wait for their "final response to my complaint" before writing to FOS. It was only after I involved FOS that they took any notice of my complaint.

    It seems that their employee did not do it correctly and if so, SW are obligated to compensate OP for whatever he has lost. They cannot simply void the sale and return his money
