Solicitors - Can they do a CRB check?

  • Any employer can do a crb check through an umbrella organisation.the employee would have to agree and fill in the form.

    I know builders with crbs.

    I personally have had 11 crbs done in past 3 years. It's a silly system.
    June challenge £100 a day £3161.63 plus £350 vouchers plus £108.37 food/shopping saving

    July challenge £50 a day. £ 1682.50/1550

    October challenge £100 a day. £385/£3100

    First of all there are LEGALLY REQUIRED CRB checks. These are when the worker is in a particular job such as working with children and vulnerable people and the law states you HAVE to have a CRB check

    Then there is everything else. There is nothing in law which states that an employer cannot ask for a CRB check. There is nothing saying that an employer cannot ask an applicant to get a CRB check. There are limitations on employers getting them directly but they are perfectly entitled to make getting a job reliant on getting a CRB check which you must provide. Your choices then are simple - pony up or don't take the job.

    I am sorry Hammyman - I rarely disagree (well other than on politics!) with you but you are incorrect on this. Legally required CRB checks cover far more professiona and areas of work than children and vulnerable people - there is a proscribed list of all the relevant employers / sectors on the CRB website. No employer outside this list can obtain a CRB check.

    Individuals cannot obtain a CRB check on themselves - so the thing stopping an employer outside this group from asking an employee or potential employee to obtain such a check is the fact that they are not able to!

    You are not talking about a CRB check - you are talking about a police data disclosure (which individuals can apply for) - this is not a CRB check, is a very different animal, and does not contain any and all information pertaining to an individual because certain types of information are specifically excluded. These can be obtained by filling in the required form at a police station and handing over your £10 (or I think that is how much it currently is - not sure).

    But since the question was specifically can solicitors obtain CRB checks and the answer is yes - this is rather moot.

    Rubbish

    You cannot get a CRB check (certainly at enhanced level) on yourself. In fact unless there has been a recent change you cannot get one at all.

    The reason at enhanced level is that information may be disclosed, in confidence, about suspicions that are currently being investigated by the police or other authority. Obviously if you could get this information yourself you would know they were on to you!

    The whole concept of being blacklisted on the basis of unproved allegations which you are not even aware of stinks in my view but that is another matter!

    The umbrella organisation check it and sign the form.

    No, they are not. Unless you are in a proscribed occupation/profession, it is unlawful for the umbrella organisation to authorise the check.
