Advice with faulty sofa bed

Sorry in advance if I ramble but I need some advice please

My parents bought a leather sofa bed from a large store in January of this year. It was delivered in March and straight away they notticed that when you sat on the sofa you tend to slip forward and the cushions don't sit correctly on the frame. They contacted the company concerned who sent out an independent furniture inspector. She came and said it needed new feet which were ordered and then fitted. They made no difference at all. The inspector said there was no other problem. We contacted the company and said we weren't satisfied and they said there was nothing else they could do and we would have to contact the furniture ombudsman, which we did. After a few weeks of waiting we had to send photos etc and they have just replied tonight saying that the company have agreed to re-fill the cushions. My parents are so frustrated as we don't think it is the cushions that is the problem but the sofa bed mechanism. They have two other sofas in the same range that they have had for four years and have had no problems with them at all, which is why they bought this sofa bed in the fist place. Has anyone any suggestions what we can do and what rights do they have? Thanks in advance for any help and advice. (hope this makes sense!)

    My advice = Contact consumer direct firstly,

    But... Your parents may be able to initiate a small claims case on the grounds that the goods are Unfit for purpose, providing they are able to demonstrate that this is the case. Firstly, contact the company involved and request that they refund or exchange the goods for goods that are of satisfactory quality and fit for purpose, should they refuse, kindly send them a (via recorded delivery) letter stating that should they not resolve the outlined issues, you will be initiating a small claim.

    Obviously, keep a record of each bit of correspondence etc... And good luck!

    A small claims case wouldn't be recommended at this stage.

    At the moment you don't know what the fault is or whether it was inherenet -- nor do you have any proof to support a claim.

    What you need to do is get your own independant report. Find a local furniture specialist and ask them to inspect and discover the fault. If the report shows the fault to be inherent (IE not a result of reasonable wear and tear) then send this via registered post to the seller asking them to provide a remedy under the Sales of Goods Act.

    Only then will you have a chance at winning in court.
