Lowell Portfolio - Credit File

Hi All

I have been paying Lowell Portfolia back at £11.50 for the past 2-3 years, this related to a debt with Capital One of about £900 - I have now got this down to £438 - anyway, today I called to change my direct debit, and he said 'just to let you know I have requested a copy of your credit file' - I queried this and he said he has requested this from Experian to check my financial circumstances - (good luck mate im not living there anymore) - I was going to tell him my new address but not now!

anyway my question was, can he request a copy without my permission? he advises he can as they are the legal owner of the debt! I dont think they can but welcome anyone elses input?

    They can as all rights that you had with cap1 transfer, they will know your new address once they search anyway
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    oh well, they aint getting anymore off me! They will see all the credit I have and ask for more money now! All cos I am trying to do the right thing! :mad:

    if you are continuing to pay at a rate of £11 a month on a £438 debt, all they can do is ask you to increase the payment (keep an eye on the DD though, as they have been known to be naughty). If you say no, there is nothing you can do. A judge would laugh at them if they tried to go to court while you kept to this payment schedule, which is on a par with what repayment of a CC under contractual terms would be.

  • As said above, your credit file will be updated with your new address so they'll easily find out. They can also do trace enquires and charge you for the priviledge.

  • He's looking at your credit report to see who your paying your money to and if your paying out a ton of money to different people and your paying him a small amount he will want the amount increasing.

    Not stupid are they? and seeing as its a credit reference agency and he can see all your credit agreements.

  • Who cares just tell them they arent getting anymore money and thats it. You've paid them the £11 for the last 2-3 years, don't offer anymore and there is nothing in this world they can do! No judge would entertain them.

    As me da would say. Tell them to kiss ur a*se. Irish style!

    they could always take it to court at extreme, and request that under oath you disclose all income/outgoings this proves why companys dont trust and ask for evidence as seems to me that the op can pay a lot more really

    Lowell won't go near a court, unless there's considerable property equity, and certainly not for this amount.

    A Judge will be satisfied with the payments being made already, why should he repay at a faster than the originally contracted rate, which is approximately what the debt is being repaid at.
    It's a health benefit ...
