CCJ Nightmare please help

In November 2006 I had a car accident, in my opinion it was probably my fault, however Direct line chose to dispute liability, I forgot all about the claim, work was completed on my car and as far as I was concerned that was an end to it all. In March 2007 I was shocked when out of the blue I received a court summons because Direct line had not settled the claim, I contacted Direct Line and they told me to ignore the summons and they would speak to the solicitor and settle the claim. To my horror in mnid April I received a CCJ in my name as the claim had not been settled!!!!! I was horrified, I contacted Direct Line who assured me the money had been paid and they would contact the court and solicitor to have the CCJ dealt with. I never gave it another thought. Until last week when my husband and I were remortgaging and I was told there was a CCJ registered in my name from 2007, as you can imagine I was not amused. I have contacted Direct Line who are being very evasive, they tell me they are having a letter faxed over from the 3rd party solicitor that shows the claim was paid, but this leaves me with a ccj, I want it removed from my credit file............has anyone got any advice about what I can do? I would like to take action against direct line for all this aggro-it's disgusting how this has been allowed to happen.:mad:

Get the letter from Direct Line that proves the debt was settled and when. Contact the Court that issued the CCJ and see what they say. I am not to sure on once CCJ's are issued and settled, whether they are removed or if they are just marked as satisfied. I suspect it's the latter.
You are probably better off posting this on the Debt Free Wannabe board, as they are more used to dealing with debt and CCJ's.0 -
That's very poor advice if they told you to ignore a county court summons. I'd complain to the financial ombudsman about the whole way this was handled.
Regarding the CCJ - IIRC they are usually only removed from a credit file if settled quickly (30 days?)0 -

I hope you manage to get it sorted out and your mortgage application isn't affected.
I don't suppose you have any written confirmation from DirectLine about this?

Even if they do fax the letter, I'd still be inclined to follow this up with an official complaint.
I agree with Fergie76, CCJs are discussed all the time on the DFW board.

Need evidence that it was paid.
Other side's solicitors need to apply to the Court to set aside the judgment which will then be removed from the Register of County Court Judgments. They ought to do this with a consent order which you will need to sign.
As they were wrong to apply for the judgment, they should pay the costs of the application.0
