unauthorised debit card payment

Hi Can someone give me a little advice?
I have just found out that Wonga have taken money from my Dads debit card for outstanding money...
I have just started a DMP and was advised to canx my own debit cards so no payments where taken but my dad made a payment for me to Wonga months ago and as they now have that card details they have taken again as they could not get from my card...
Is this legal as my dad has not given authority for this payment, and do I have any recourse?:(

Unfortunately they will use any card they have details of to secure a payment.Try to be a rainbow in someone's cloud.0

Unless they have agreed, in writing, to your DMP (very unlikely) then simply cancelling your debit card will do no good as they will continue searching your account for money to appear and take it immediately if they find it.
As above, any card details you give them are now fair game and if money is still outstanding they will continue to raid your fathers account.
Cancelling cards will do no good. You and your father will need to close your bank accounts and open new ones elsewhere.0 -
You need to slap yourself for taking out a Payday Loan knowing you were going to avoid repaying it.
You've obviously had previous dealings with them so you should have known how they work, did you REALLY think it would be that simple to rob them?
Here's some terms you should have read at some point when taking out loans you knew you couldn't repayIf your balance isn't settled until after 5pm you will incur a default fee, so please ensure the funds are there before and repay them by logging into your account and clicking ‘repay now' or calling our payment line number on 0207 183 0063. Please remember however that if we are unsuccessful in collecting full payment by 5pm on your promise date we will charge you a £20.00 missed payment fee. We may try to debit your debit card at a later stage and on more than one occasion after 5am on the promise date for all or any part of the amount due. If you have provided us with details of a second debit/credit card and we are unsuccessful in collecting payment from the first debit card, we may seek payment from the second debit/credit card and on multiple occasions, for all or any part of the amount due, as we determine necessary until full repayment is made.0 -

Well that seems plain enough.Just as a matter of curiousity suppose in those clubs where the wealthy put their credit cards behind the bar at the beginning of the night and pay at the end,if a barman was to note down the cards number including the 3 digit pin on the back could he/she use it to pay off one of those loans and if so how would the owner of the card prove he/she didnt authorise such a payment and get their money back??counting down the time I got left.:beer::beer:0 -

Leaving your card with a stranger would generally invalidate any protection from the issuer. So they would not get their money back.0 -

advise them your father made a one off payment, and now that youve defaulted they have taken money out of his account. remind them he is not a GUARANTOR FOR THIS LOAN, and he is seeking his money back right away. they should faster payment back to him.... he may need to be there, as they may want his bank details to send the money too.......Promo codes are never always cheaper..... isnt that right EuropCar?0 -
Alternatively,
(1) Thank your lucky stars that they now have their payment and have turned the daily interest clock off.
(2) Apologise profusely to your father and reimburse him the money that Wonga has taken.
(3) Either never, ever, ever use Wonga (or an associated payday loan company) again, or tell your dad he has no option but to close his bank account and open a new one.DMP Mutual Support Thread member 244

No its not - if the OP's Dad agreed to a single payment then that is what he agreed to.
He should go to his bank and inform them that the latest payment was not authorised by him and he wants it reversed in accordance with FSA rule BCOBS 5.1.11R
Wonga will not be very happy with the OP but that is not Dad's problem.0 -

How do you prove that card details were given for a one-off payment?
What good would reversing the payment do? All that would happen is that more charges, penalties and interest would be added immediately and would continue to be added until the loan is repaid. How does that help the OP? If he can't afford to pay his father back immediately, he definitely won't be able to pay Wonga what he owes and the debt will just grow and grow.
Maybe the OP will feel more obliged to cut down on the spending and pay his father back than he would if it were just a payday loan company wanting their money back.DMP Mutual Support Thread member 244
