Paid for next day delivery but still waiting!

Hi,
I ordered some electronic goods from Ebuyer at 9pm last night and decided to pay a significant premium for next day delivery. The site clearly stated that any orders placed before 11pm would be delivered next day, even going so far as to have a clock counting down that said "order in the next 2 hours 5 mins for delivery on Wednesday".
I waited in today for the goods but they had not arrived by 4pm, so I checked on the Ebuyer website to see if I could track the goods. There, I found that the order had not even been sent yet and so would not be here today at all.
I rang the customer service number and explained the situation. The guy told me that because Ebuyer had not received the money from the bank until after 11pm, it would not be delivered until Thursday. I explained that this was nothing to do with me and asked for a refund of the (very expensive) next day delivery fee but was told no, it was not Ebuyer's fault so I was not getting a refund.
It wasn't my fault either! Any ideas?

Cancel the order under the The Consumer Protection (Distance Selling) Regulations. They have to refund all the money you have paid them. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -
At this moment in time are you able to cancel and has the item been dispatched?
If not, as above, cancel then reorder if you want and they have to refund ALL money.
If they have, you will likely have to pay return postage costs so it's a case of is the saving worth it?0 -

I think that would only be if it was received. If it is cancelled before receipt the OP would not have to pay for returning the goods. I might be wrong though. The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0
