    I think it's not that these 2 rights conflict but rather that LL must exercise right (1) in a reasonable way so as not to breach right (2).
    And obviously T must also let LL exercise right (1) as long as LL exercises it as above.

    True - better wording would have been "these two rights can conflict, and in each case only a court can decide ..."

    This is why letting agents really should be regulated, and there should be a requirement for training and a qualification.

    I agree. Just like Chartered Surveyors and Solicitors, let's have Chartered Letting Agents- with high professional standards.

    if i was still a property manager then I would, but as I am an EX.....:p

    at the time I was ARLA trained but I completly agree the standards are absolutely shocking even for those that do carry the 'professional' logos and there were many companies that I would never ever have worked for, and many people we would never have employed beause of who they worked for... I have left a couple of companies because of their horrendous practices and have moved into another field because I was not prepared to compromise my own integrity.

    they already esixt, ARLA & NAEA spring to mind, but they are voluntary. The government were not interested in making it compulsary from what I recall as they said it would be too difficult to manage. But even those that are part of the above schemes can chose to ignore it, and people don't care so long as the agent has the property they want - only later when the nightmare begins to they realise the importance of qualifications....

  • Thanks everyone for the advice, I am still waiting to hear back from the LA.

    I am more than happy to compromise on this and have already agreed to 2 stints of 3 hours on a saturday, what has really annoyed me is the attitude of being TOLD that a booking has been made and if I am not home they will enter with the key, the LA said it has been done like that as he "has left hundreds of messages for us which have been ignored" except I have had ONE message on my home phone and NO missed calls on my mobile (which I gave them my new number to when we first discussed viewings as it had changed from the one on file)

  • I agree with you standing your ground on principle. May be you should just tell the EA to mind their tone a bit and be more polite if they want your co-operation.

    This seems to be a big issue out of nothing. Are things that bad that two parties can't even agree on a convenient time. What is the world coming to !
