URGENT! Income Support/Housing Benefit/Council Tax/Bailiff.

They will force entry, they will threaten and assault you, you have to expect the worst. The Council will say that they can't talk to you because it is now in the hands of the bailiff. These bailiffs are scumbags and the Council are inefficient . If they say they are having a heart attack let them have it outside on the pavement. Phone the police immediately they arrive. Write an email to your MP and everyone on the Council website giving brief details at least you will have a record
I am 62 years old, I am going to court on Friday, 2 bully boy bailiffs forced their way into my home on 18th July, damaged the door frame doing so, did not identify themselves, assaulted me several times I phoned the police who although they did not know anything were quite helpful, they saw all my bruises on my arms, feet where stamped on, various bruises face - finger marks on my cheek -where one of them punched me in the breast. I slapped one of them, the bailiffs told the police that they had never seen such aggression in their whole lives! these are bailiffs not Father Christmas and the Tooth Fairy!! A WPC helped me on the phone to the Council who were obstructive, now in bailiffs hands etc I moved into this house about 18 months ago, informed them, thank goodness for emails have record of everything and they have been crediting my payments to the previous house but Council cannot transfer payment because now in bailiffs hands. Bailiffs have insisted that I am prosecuted but I will make sure everyone knows about it and will phone the papers, pleading not guilty - self defence. Bailiff admitted to the police that he hit me because he THOUGHT I was going to hit him, I admitting slapping his face, no mark at all, becuase he HAD hit me. Someone wants to seriously look into their outrageous behaviour, everyone knows how they behave but no one seems to be dealing with it. Council inefficient, bailiffs illegally entered my home. I am not trying to scare you just telling you what they do. Please do not rely on them, or the Council do the right thing, doing what they are allowed to do and not being bullies and liars. I am not sure where you go for help there must be some sort of organisation who can help, I am sure someone here can advise but get help urgently. I hope the bailiffs have been charged with assault
A local authority can and should take a debt back from the bailiffs especially if there is a !!!! up at there end
I hope you are/have made a formal complaint to the ceo of this council and take the bailiffs to court with a form 4 complaint
can i ask what bailiff firm this is as i was wondering if this was a Capita (who administrate council tax for a lot of local authority's)Equita bailiffs(who are part of the Capita group of company's)

if people paid their bills or kept up communication with the people they owe money to instead of ignoring it and hoping it will disapear then they wouldn't get to the point of having bailiffs at their door in the first place. there is a long and drawn out processs to go through before bailiffs get involved, people should try dealing with those before moaning that you've been treated unfairly, I'm sure the people that are owed money in these situations are the injured party. You can't get away with not paying what you owe...0 -

It's Rossendales, I haven't managed to get any reply from the Council since the incident on 18th July despite emails to all and sundry
No it is me who has been charged with assault! I slapped one of them once, not hard no mark, after they both assaulted me I was covered in bruises and marks. WPC who attended, 5 police cars, did not arrest me at the time, more or less told the bailiffs they were silly boys and to clear off, they mentioned making a complaint, she couldn't see any marks on him but I was covered, in my own home etc they admitted they had hit me because they THOUGHT I was going to hit them, I admitted I had slapped one of them round the cheek no mark because he HAD hit me several times and pushed me, WPC said tit for tat so I was surprised a couple of weeks later to be charged, no one has taken a statement from me or my husband or son who were present. I will go tomorrow and go not guilty self defence and it will be adjourned, thank you for your good wishes. am quite articulate and keep paperwork, not organised all over the place, but goodness knows how other people cope with them
I have no criminal record of any kind 3 points on licence for minor speeding 30 years ago. It seems I have taken up attacking people and being violent as a hobby for my retirement!Loretta0 -

I was in my own home, I am 62 my husband is 70, when these 2 men forced their way in. I did not know who they were, no identification shown and one punched me and said 'now you know we mean business' I did not owe any money, I moved 18 months ago and notified the Council, by letter and luckily email so I have proof that I had moved. The Council tax I paid was credited to my previous address so that 2 people have been paying full council tax there and no one paying here. I did receive a letter, eventually, about the change of address and the reply sent to my new address was - thank you for letting us know your new address here is the current council tax bill for house you have told us you no longer live in!

Appears in England the Bailiffs think they're above the Law! Never heard of the Sheriff Officers here in Scotland act in such a manner, even from people who have dealt with them.
Do these Bailiffs go through training?
I once had people from a well known weekly store and they forced entry to a mates house. Lucky I was in and understand Scottish Law quite well.
They though he was in himself, that was til they reached the sitting room and I placed them under a Citizen Arrest for Housbreaking with intent to steal! Both were charged in court.
Bailiffs and the alike including the Police rely on people having no knowledge of the ins and outs. Then when they do click on you know what they do, they hate it! Bully tatics from these people are shocking.0 -

I was interviewed about their complaint, I have not made a statement when I asked I was told it would be done later, neither has my husband. They will just have to guess what I am going to say. Yes I took photos and the police took photos. I have also taken photos of whre I live, isolated cottage on the edge of a village off the main road on a slip road, not overlooked, high hedges etc damaged door frame. I have seen GP I had breast cancer and lymph glands removed but very lucky of course because I survived it not complaining at all and I have to keep my arm moving otherwise liquid collects and I have to have it drained off slightly painful all the time and no strength in it very annoying, keep dropping things, but I am still working full time, this is the hand I slapped him with, it must have felt like a wet lettuce to him, is that the expression!Loretta0 -
What I really want to say is don't presume you are dealing with officials or professional people who will make sure they do the right thing even though it may not be pleasant. They are lying thugs and bullies and I really don't know why no one is looking into their behaviour and doing something about it, they are like those car clampers but at least there seems to be something going on about themLoretta0

Actually their version is almost exactly the same as mine, they have admitted they broke the law by forcing their way into my house, damaging the door as they did so, the did not show identification, they are 'waiting for their new ones to arrive', they admitted pushing my 70 year old husband to the ground because he was trying to close the door, I am allowed to defend myself and my family when 2 unidentified thugs break into my home, have you not read recently about the people who are not being charged for killing the burglars who broke into their homes? this was no different. One light slap on the cheek, no mark, by a 62 year old woman is quite different from a physical attack leaving many bruises, 19 on one arm alone, cuts and scratches is a bit different. Their defence is that they are bailiffs and they can do as they like. Unfortunately the police seem to know very little about bailiff law and presume that they are fellow 'lawmen' and automatically take their side without further thought. Since then I have made a complaint to a Judge for them to lose their certification, she agrees they have behaved outrageously s before long they will not be able to do it to anyone else.
I do not owe any money, I knew that and it has been confirmed by the Council at long last. They had been crediting all my payments to my previous address despite me telling them several times that I moved 18 months ago, they did not notice that at my previous address 2 seperate people had been paying the council tax and at my present address no one had been paying. When they eventually found that they had allocated the payments to the wrong account they the refused to move them to the right account because 'it is in the bailiffs hands now there is nothing I can do'. They did however manage it quite easily when my MP got in touch with them though!
I had my post redirected for 1 year which I thought would be long enough even for the Council to work things out but unfortunately they did not start chasing the debt for 14 months. No communication before that. It is not a long drawn out process before they send the bailiffs in, some Councils instruct bailiff when 1 monthly payment is late.
Don't think that everyone out there is spending their council tax money on 60" flat screen tvs, this is one of those urban myths but there are still a few people, you are probably one of them, still out there who believe it. If this happened to me it could also happen to you quite easily, paying your bills in full and on time will not prevent it. Do let me know if you have any further silly comments to addLoretta0
