    If the s.13 notice was served correctly the new rent becomes due whether you agree to it or not.

    The only thing that can be done is to appeal to your local Rent Assessment Committee if you can show that the new rent is not in line with the local market.

    Also, as already mentioned, you had time to serve a notice to quit to end the tenancy on the 31st September in order to avoid the increase completely.

    As it was a section 13 notice, you have 2 choices:

    1) Pay
    2) Dispute according to the info on the s13 notice
    3) There is no third option

    If you don't dispute it within the correct timescales, the new rent will automatically apply.
    If you dispute it, and the Rent Assessment Committee agree with the landlord, then even though you will have left the property, you will have to pay the rent shortage from the proposed increase date to the end of the tenancy.
    Life should be a little nuts; otherwise it's just a bunch of Thursdays strung together.

  • A further development....

    Our potential L/A has contacted out current L/A to ask for a reference. The current L/A has called me and said they want £25 for it and will not do it until we give them notice that we are moving. If something goes wrong and this all falls through, we'll be left homeless!

  • If they have given you this info my email I would be minded to forward it to the prospective agent to let them see what your position is. Naturally, you cannot give notice unless you are certain that you will have somewhere secure for your onward move. I'd be very surprised indeed if the issue of a reference from your current landlord was the only thing holding things up. Have a chat with the new agent asap

    I've spoken to the prospective L/A and they've said the current L/A is being awkward. They've told me not to give notice and she will speak to the Lettings Manager to see if they can sort anything out... *sigh*
  • Right.... further developments...

    All the checks have come back fine (except the L/A one) so we're going to give notice. Despite my original T/A stating 2 months notice, we're giving one months notice as we are on a statuory periodic tenancy. Does any have a template for a letter? I'm hopeless at making sound like I know my rights!!
