You may feel it's not worth pursuing, but if the employer is a local authority you could write to the leader of the council, who is an elected member, as well as the director of social services.
The leader is more concerned about the authority's reputation because it means votes.
The employer is trying to fob you off, but they really cannot wash their hands entirely of inappropriate and possibly illegal behaviour by an employee.
Did any of the communication occur in working hours, from a work phone, or work email address?
That would help your case with the employer, whoever they are.
Another tactic would be to go on the offensive.
Do you have a work number for this woman?
Ring her - several times - and giver her a piece of your mind.
If you can't get through, leave obvious messages with a few colleagues.0 -

Thank you NeverAgain. It was the Director of Social Services that I wrote to, but I think I will write to the leader of the Council. I'll do anything to have this stress taken away.
I don't think I'll go with the phone calls though because I'm just not that sort of a person and would hate for people to think I'm just as low as her.

I can't understand how she can say that you are selling a pony? Surely if the pony is not yours and the contact details are not yours the pony is nothing to do with you? Surely she can't just make up complete rubbish?
Regarding the bank payment thing I'd check your bank every month to check the payment has gone out - if not then can you get something from your bank saying the payment has been refused/the account has been closed? If this happens I'd have a stock letter ready saying - I've been informed that the bank payment hasn't been made this month due to x,y,z. Please can you provide me with an alternative.
Keep copies of everything in writing and gather as much evidence as you can as she sounds like a nasty piece of work.
I'd also consider going to a CAB or similar or community legal aid centre to see if you qualify for any help and advice. Alternatively you could see if you've got free legal cover with your mortgage/insurance cover etc.

When I spoke to the Bailiff and told him it wasn't mine and the contact details were someone elses he just said he didn't want to get involved with it, but was happy to keep saying I could go to prison for breach. I understand that the Bailiffs probably have some untruthful people to deal with, but surely that cannot just accuse me of doing something without it being checked out?
Anyway, I've made an appointment with an Officer for Friday at my local station and I've written a letter to the Scotish Social Services body.....but can't print it off because I've run out of ink - Typical.
I just have a letter to write to the lead Councilor and hopefully this woman will stop trying to walk all over me. I hate having this to deal with, but it's made me feel better that I'm fighting back!0 -
Was it done through the English Courts or Scottish courts?
It might be worth giving National Debtline a call (I presume they have a Scottish department).
Surely it's not up to the bailiff to randomly decide whether you are or aren't selling this pony and whether to send you to prison? Surely it's up to the courts to decide? I would have thought that the other woman would have to go back to court and argue her case for committal rather than just her say so.
Get your facts straight and don't rely on the bailiff to be on your side as he may well either a) not know what he is talking about b) not care or c) be using it against you -sadly there are some dodgy bailiffs out there. Before panicing about whether you will or won't be sent to prison I'd get some facts from someone impartial.

Frankly you ae going to have to play her at her own game on this one. If she decides to abuse her position and re-apply for a warrant you will have to go through the correct channels and discredit her etc etc. It's a real pain for you but you should not have to put up with this. I believe if you give her enough rope she may well hang herself. I'm sure if the matter is thoroughly investigated she could face disciplinary action for the way she is behaving and possibly even be struck off as it sounds dreadful.

DF it was done through the English Courts.
I think the problem is that my local court close down at the end of this week and everything is being sent to another court. I don't think the Bailiff cares to be honest and I also think he knows nothing when it comes to a situation like this..............and neither does anyone else at the Court.0 -
Some months ago I posted on here about someone taking me to Court. I lost the battle and was ordered to pay just over 2k. I'd had a really tough time nearly loosing my new born and so I just gave in. I started to pay 30 per month to this woman until she closed the bank account I paid into. She then got a warrant issued for bailiffs. To cut a long story short I had to apply to set aside the warrant and sat in front of a judge and explained what had happened. I'd also involved a solicitor, but to be honest they were not very good and I couldn't keep paying for them to do work that I ended up doing.
This woman is awful behind the scenes and I'm not trying to make myself look good here. I have an email from her saying that if she can bump the court costs up enough she will bankrupt me. I have religiously paid every month without fail. My September payment was with her three weeks ago, but she's done it again and re applied for a warrant. I spoke to the bailiff today who knows the full story and has been shown the evidence that I'm telling the truth. He says he has no idea what to do. Even the Court don't want to know!
How can I make someone listen? I'm dealing with someone who won't let go! The person in question is a mental health social worker. Can I complain to someone to try and stop her? She's in Scotland so everything seems so difficult. I'm at my wits end, getting no sleep and expecting my second child. I don't want to go through any more stress. Please tell me if there is any way I can stop this woman bullying me. It's so wrong that the courts won't help me when I'm the one who is doing everything asked of me. I don't want bailiffs at my door. I'm being threatened with having to go to prison because this woman has told the courts I'm selling a pony! It's not mine and all the contact details on the add are not mine. I just dont know what to do and there appears to be no one to turn too.

Are you saying that a mental health social worker that you have a "case" relationship with is lying to the courts to make things worse for you?
If so I cant see any option but to speak to the Scottish Social Work council

Looks like you've made some good progress.
Making an appointment to see a police officer is the appropriate approach, far better than pitching up at the station unannounced.
If you've not done so, look at the local authority's website to get the leader's name, or just ring the town hall - the information you seek is no secret.
I would write again to the director of social services, explaining that 'not in our time' is just not good enough.
Nothing to stop you telling either of them of your police appointment - it might drive home how serious this is to you.
Harassment is quite a handy allegation in that respect because proving it is partly down to the impact the course of conduct has on the victim.
In other words, a magistrate or jury may find the course of conduct was not harassment if I were the alleged victim, but they might find the same course of conduct to be harassment of someone who was clearly more upset by it.0 -
Perhaps you could threaten contacting your MP when you write to the Council, this helped us when we were trying to sort out our Housing Benefit. (give them a time line to respond helpfully)
Is this woman still your Social Worker, sounds like you should at the very least be seeing someone else, with such problems.
