Egg SAR Request

Hi,
I am hoping someone can help me with this. I recently sent my SAR and £10 cheque to Egg. I had 3 loans with them (one of which has just recently been sold/moved to Britannica Recoveries SARL) and I didn't know if I had PPI on them. So I wrote to ask for the SAR info. They have written back saying they have no obligation to provide the information as the agreements had ended. Is this right?
So even if I did have mis-sold PPI on loans previously - as they are not live I can't get any information on them? All I have is the agreement numbers for them (I didn't keep the paperwork - stupidly!)
Can anyone suggest any solutions or is my potential complaint dead in the water before it's begun?

What letter did you send them? It seems that this has been confused with a request for the credit agreement and T&C's. If a loan is closed they are correct, they are under no obligation to send this to you. However they have to legally send you all information they hold on you if you request a SAR. There is fab template letter on this site for the subject access request (its on a sticky titled SAR letter) this is the one I used and Egg have written back to me confirming that all of the information will be sent to me within the 40 day requirement. The amount you have sent is correct but if you sent a letter with £10 asking for a copy of the credit agreement this may be why its been sent back.

I sent a SAR letter. Think I actually got the text from SME actually. Any ideas?
This is what I sent:
DATA PROTECTION ACT 1998
SUBJECT ACCESS REQUEST
Dear Sir/Madam
Name: Me
Account No’s: XXXXXXXXX
I understand that you currently hold details of my personal and financial information within your internal record systems with regard to personal loan accounts and credit cards accounts
I would be grateful if you would provide the following for ALL accounts or associated accounts I hold or have held with your organisation:- Full copies of all contracts which you believe exist or have existed between myself and your organisation, including true copies of any documents you hold in support of the same.
- A complete list of all transactions or statements relating to ALL of my Loan Accounts with your organisation.
- Copies of all documents which include any of my personal information including copies of any contacts or invoices, emails or computer records containing my personal information, or any records which pertain to this information.
- Full copies or transcripts of any correspondence in postal, email or any other format which you have entered into with any individual, organization or third party which contains my personal or financial, or which pertains to me.
- Where any previous information or records held have been deleted or disposed of, the methods used to do so, including dates, certificates or references confirming details of destruction. Where you are unable to provide such certificates, please provide a declaration, signed by an authorised officer of your company, confirming the dates and methods of destruction of this data.
- Full hard copy print outs of my personal or financial information, held in a digital, magnetic or any other format which is held in any archives, backups or other storage devices / locations.
- Underwriting sheet or other such document recording any commission (or other) payment made to an intermediary or packager, and/or payment/commission from the insurer in relation to my account.
I request that you provide all the information requested above, even though you may consider that it falls outside Data Protection.
I reserve the right to refer to the contents of this letter if an application for pre-action discovery is necessary relating to any of the documents requested herein.
IF YOU ARE UNABLE TO DEAL WITH THIS REQUEST, YOU SHOULD IMMEDIALTELY FORWARD IT TO THE PERSON WITHIN YOUR ORGANISATION RESPONSIBLE FOR DATA PROTECTION.

The fact that the credit agreement has ended is not a valid reason to deny you the records they have about you and your financial history.
All companies have a legal obligation to supply you with the data you request under the Data Protection Act 1998 except under very special circumstances. It is not optional for them, they must comply or else they can face very hefty fines from the ICO.
I would write back and tell them that unless they comply fully with your request within 40 days then you will report them for a breach of the Data Protection Act 1998 to the Information Commissioners Office.Its amazing how these banks can't even do simple calculations correctly..............0 -
