  • If the work on the side for the friend is legitimate he can claim immediately. If there is no more work and the friend is prepared to confirm that with the JCP there will be no sanction.

    If the work is cash in hand then the previous employment will count. If he left with medical advice then he may not face a sanction, but the only way to tell is to actually claim. The maximum sanction is 26 weeks (not 28 as noted above), and he will be paid whilst a decision is made.

    However, you describe him as your other half - do you live together? Do you work? If the answer to both of those is yes, he's unlikely to be entitled to any benefit at all unless he qualifies for contribution based JSA, which he'll get for six months, if he's paid enough NI in the last 2 full tax years. If you think that may apply, he needs to apply now otherwise his entitlement to this may lapse whilst he's waiting.

    what part of doing work ON THE SIDE did you not think was illegitimate. So yes he would almost definately be sanctioned, nobody can say 100% as it's not just down to guidance but what the individual decision maker deems apropriate.
