Roaming Charges and EU Outermost Regions

Hi All,
Is anyone able to confirm whether roaming on networks within the EU outermost regions should be subject to EU law on roaming caps?
My understanding is that it should, in which case the Tesco Mobile roaming list here is either wrong or Tesco Mobile are not acting in accordance with the law as regards Guadeloupe (and the countries listed along with it).

Martinque also seems to be shown inconsistently as region 1 or 4 depending on where you look.

Yes, St Martin in February (which is listed under Guadeloupe on the Tesco Mobile site for some reason).
I realise that I'll have to use the networks on the French side, not the Dutch for it to count but we're staying on the border (literally)....0 -
You have enough time to get a response from Tesco then.
Although you are correct, is it worth a big fight with Tesco over this.
You can use PAYG from Orange, Vodaphone, 02 and T Mobile that includes them at EU rates0 -

Well I have credit on Tesco Mobile that I will want to use, as does my wife. Not that we expect to use a lot, but there is a principle that I'm willing to push.
From Tesco Mobile's perspective it should be easy. I can't imagine they'd want a fight over it given that they are in breach of EU law if charging the higher rates. I suspect it is actually a mistake, particularly since O2 (with whom Tesco set up Tesco Mobile as a joint venture) are charging correctly.0 -

Although having checked it, O2 are also charging well in excess of the caps.....
Vodafone on the other hand are charging rates within the capped amounts and interestingly are also offering Vodafone Data Traveller at £2/day (normal EU rate) rather than £5/day (rest of the world), even though they are under no obligation to do so.0 -

Just had a call from Tesco Mobile confirming that I was correct, having refered it to their legal department.
They are now going to amend the pricing accordingly and then the website.
If anyone is visiting the French West Indies (or other Overseas Collectives / Departments of France) in the near future, I suggest you check that you are going to be charged correctly for roaming, especially with O2 or their subsidiaries and partners (e.g. giffgaff as well).

Looks like the Tesco Mobile website is already updated with correct pricing.
They forgot to make the Region 1 summary box bigger to accomodate the additional entries though
