Hi I hoping someone will be able to offer some advice. I pawned a watch with Cash Generator back in 2009 whilst going through a bad time. The problem is that at the time i was made reduntant and our house was in the final stage of being repossesed and the car also so the watch went to the back of my mind and thought i would be reminded to redeem it by Cash Generator before the time was up. Well they did remind me by letter as they are meant to however they sent the letter 2 months after the redeem date. Date of letter 09/06/2009 and redeem date 27/04/2009, i did phone them when i got the letter and they said that a lot of letters went out late and laughed about it. At this time i was looking for a new house to move into as the date of repossesion was only 1 month away so had other things to sort out. We are now sorted after 2 years of struggling and trying to sort our finances out and this has come to the front of the que. Is their anything im able to claim or do as they sent the letter out late and i was unable to redeem the item (which i did want to do) even though it was 2 years ago? Thanks

I would have though it was your responsibility to redeem or extend the pawn broking loan before the deadline in April 2009.
If the contract says they would write to you and as you said they did BUT LATE you should have addressed it in June 2009.
I would think you have a weak case as you have left it so long. You have moved on / are sorted, so really is it better to draw a line. (AND FORGET IT)0 -

I know it has been a while but is there a time scale for these sort of things to be sorted out before you can try to sort an error like this out. I would of let it go but the watch was worth around £600 so it is quite alot of money. Thanks

Really, I'd give up BUT YOU COULD TRY Consumer Direct :- (there is a 6 year cut off period for suing for debts, faulty goods and perhaps other plausable cases)

Have you contacted the pawnbrokers? Do they still have the item or have they sold it on?0

Do you have a copy of the contract still?
#2 pretty much says it all. It will likely be in the contract that you are responsible for acting within the deadlines.
Contract aside, the fact you no longer own the watch is because of a fault of your own and not theirs. It would have been sold on a long long time ago now.0 -
maybe there were other letters before that one that you did not recieve ??

I think i still have the agreement and the letter is right in front of me. When i did phone them the lady said that alot of letters had been sent out late. From what ive read the letter should of been sent 14 days before the redeem date by law due to the amont borrowed however the date the letter was sent was way after this time.
Going to see if i can dig out the agreement now.0 -
But surely having received a letter in June 2009 you would have tried to redeem the item then not wait for two years and a bit? Not sure what you expect them to do with items outside the redemption period ? Even though they advised you late at that stage they probably still had the watch and you would have been able to redeem it.0

Im only asking if there is anything i can do still. Like i said i know its been a long time but when i received the letter i was only 30 days from becoming homeless so had other things to sort out at the time.
I havent done anything till now as we have only just got sorted, in short we were homeless for a considrable amount of time and our family had to live in seperate places due to no housing and 99% of all our belongings (except the things we had in our bags to move round with) were destroyed due to flooding so as im sure you can see other things have been a priority up till now.
I think people have offered the advice i need and will see what i can sort out tomorrow.
