CCJ On mine and father Credit Report

hi there first time post here as i am at a loss as what to do, let me try to explain.
Basically recently just moved area and needed guarantor for a flat so ask my dad and was happy to do it, has excellent credit record (or so we thought), Basiclly it turns out there are CCJ's for £100 on both mine and his reports, stemming back from 2007 from the dvla for i a car that i owned and was not sorned, aparntely, i dispute that as i scrapped the vehicle filled in nessary paper work, and thought was done with, obiously not. It has now come back to haunt me, and my father who share a similar name i am JohnPaul (As It is Written) he is John.
So Northampton court has Issued us both with a CCJ, now i am not to fussed about the one for on my account at the moment, but i will be looking it to that at a later date, as letting agent are happy as long as my father is clear. how ever the one on my fathers is more important to do something about, as i risk loosing the £414 admin fee for holding the flat and credit checks etc and ofcourse loosing the flat...
So any advice would be greatfully welcomed to assit me in this matter, like what should i be doing, and who is responceable for removing the CCJ off of my fathers account as it is obviously a mistake, at the time of the CCJ with both lived at different addresses, and there is a 30year age gap between us, andmy father had lived at his address for 25years at the time of the CCJ, not mail was sent to either of us about this, so as you can imagine this has come as quiet a shock to the pair of us.

Unless you were jointly liable for the debt (can't see how) then the CCJ should only be against you.
By that I mean that the court hasn't issued a CCJ against him as such, but the credit reference agency has for some reason incorrectly matched the record of it against his file.
Maybe the court issued it as against "John Paul" in error rather than "JohnPaul"? And so the agency has just matched it based on christian name and surname? That would be any easy mistake to make.
Or maybe the court issued it in the correct name, but the agency itself has messed up matched it up wrongly in just their systems?

thanks for quick reply, yea my dad has contacted the agency Equifax, i believe it is and they are saying there is nothing that they can do, sorry i should have put that in original post, but there so much to remember. but i do appriate the quick reply, and also yea it is on his actual credit report.0

Ok. Not a simple error their end then, unless they are just fobbing you off.
If all the information (name etc) that they have on the CCJ matches up with your fathers details, then to a certain extent they are correct.
The agencies (Equifax) only report the information that they are given from the official register of judgements orders and fines. That info comes from the court itself.
So you need to go back up that chain and contact the court to check who the CCJ was made against, if there was some error regards the name, and if so hopefully get that corrected. That would update the register Equifax gets their info from, allowing them to then get it off your father's report.
If the CCJ was actually issued correctly in your name and not your fathers, then you would instead go back to Equifax with proof of that and demand that they remove it. As basically in that case the mistake would be theirs.
Until you've done the above it's hard to say who is at fault. Could be Equifax, and they aren't admitting it? Or it could be the court?Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Ok, once again thankyou for the quick reply, i will be intouch with the court tomorrow as BH today, always the case you're try to sort something out quickly and things like BH get in the way. Could I just ask one more question though, would you be able to give a rough time frame of removing this from Fathers report if court is at fault as in all honesty its looking like that, do you know how long matter like this talk to resolve, not looking for info down to the day, but is it likely to take Days, Weeks or Months, in your opinion. Ill let you know how it goes too, thanks so much for the quick information you have been able to give me.

If the court info turns out to be all correct and the mistake lies with Equifax (despite their denial) then it should be quick to sort. i.e. days. That is if they admit it and cooperate.
If the error is with the court it might take longer? Firstly getting the court to sort it, but then also having to wait for the updated info to get onto the register and then be picked up in turn by Equifax. Great thanks, its really so i can give the letting agency a time frame of when things should be sorted, i have agreed to pay 6 month rent in Advance (£4600) so i am hoping that can can understand that there has been a mistake along the line, as the company they use for the checks (Rentshield) have also explained the situation to the letting agency, and something is not correct on my Dads report, Fingers X'ed.

Ouch! 6 months rent up front? Seriously? I used to be a lettings agent many years ago and we'd never have asked for that nor accepted it... Please make sure that you check the letting agents out properly and you get a receipt stating exactly what that money is for!!!
As for the time line on the CCJ on your dads account... If it's the courts... you could be lucky and it's weeks, personally I'd think it's more likely to be months. You need to get the court to look into the error, cancel the CCJ - that all takes time - then you need to wait for the credit reference agencies to update the files - again that takes time... some updates can take a quite a while sometimes... sorry. There is no "it'll take x number of working days" for a scenario like this that I know of...DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!

Yea unfortunaly i am currently out of work( Just moved to new area) and unable to work until get my own place as it would start to effect my sisters family tax credits, and the landlord of the property doesnt normally take Housing benifit but was willing to if i could come up with the 6 months in advance. So i was kind of hoping if i can get a time frame then i could say to the letting agency/landlord look you got 6 months rent, this will be sorted by then and by the time the new tenacey comes round all will be good. Thank for the advice regarding checking the letting agency out, that was all done but well worth mentioning for anyone one else reading this. But fermi and MrsTine your posts have welcomed and have been of some help to me thankyou very much0
