Hi,About two years ago I moved house & my mortgage is with the Halifax,at that time as I was speaking to the financial advisor at the Halifax branch with regard to the mortgage etc and he asked if I would also like to consider a credit card with them as well.I said I didnt really want to get another card but he said he would send the forms out anyway and if I still wasnt interested not to sign the forms and that would be that.
Needless to say I didnt sign the forms as I really didnt want any more temptation to spend money but a few weeks on a credit card from the Halifax came through the post and stupidly after a few weeks I bought some things with it just thinking I would pay them off,as you can guess this has now ended up with me being at the limit on the card.
My question is, should the Halifax have even sent me a card without me signing an agreement with them and am I in any position to query them about this. Any help with this would be really appreciated.

You would need to read everything that you have signed to see if anything covered it as well.... of cause the easiest thing is simply to write to them telling them to cancel the accountAll posts made are simply my own opinions and are neither professional advice nor the opinions of my employers

As I understood it the credit agreement that you sign is just to make sure you agree to it's terms and conditions and all it's charges. It doesn't mean they can't try and get the money off you if you refuse to pay what you've spent on it if you didn't sign it or they can't prove you never signed it. Although I thought you had to sign and send that back in before they'd send the actual card to you.
Question would be, if you didn't want the card, why would you use it? I don't think that would stand up in court as being "misold" something, since you obviously went on to using it. Fair enough you never agreed to the terms and conditions but I think you'd still be forced to pay back the money you've spent on the card (maybe excluding the additional interest charges that you never agreed to since you never signed the agreement, but I doubt you'd want to try and take a bank on for that)
At best I think you could get away with paying them back what you spent excluding the interest, at worst you pay it all back with interest.
I think you basically should have phoned them when you got the card and told them no thank you, or better still just said at the time of your mortgage you didn't want one.

The best thing you can do is cut up the card now and pay it off.
Even if they did send the card in error, that didnt mean you had to go and max it out. Did you not phone them when it first landed on the mat?0
