Temporary Traffic light rules on jumping red light

Can anyone help - is it ok for the police to book you for jumping a temporary red light at temporary road works which you thought was broken as it was on red for more than 10 minutes. The police were sat hiding around the corner watching and also this was at 4.00am.

Technically yes, I would post this on pepipoo.com(speeding and other offences) it seems a bit strong for them to do so.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

If it is any help, I have had advice from a fairly senior officer on a similar issue before - namely, a motorcycle failing to trigger the induction loop that controls lights off-peak. A set on my regular route to and from work would never respond to my machine late at night and I could be stuck there for ages till a vehicle with enough inductive mass to trigger the lights drew-up.
I was told that in this situation, or when a light had failed altogether, I would have a defence/reasonable justification if I waited a reasonable time (he suggested 3-5 minutes), took careful note of the presence of any traffic with priority, proceeded with caution and remained ready to yield to any traffic that appeared when I was going through the light controlled area.
So far it has never needed to be tested, despite those lights being under cameras - I presume someone in the local traffic control is aware of this situation - and they are right at the end of the road from the main police station!0
