Whilst on the subject of how long it takes to agree an IPA?
Has anybody ever had an IPA offered, close to AD, and successfully got it to 'time-out?'
On the subject of morals?
How many of you out there actually pay a gas or leccy bill the instant it drops through the letterbox?
Or, like many of us, actually wait until the red letter arrives, simply to allow more time to get the cash together?
Nothing wrong in spinning something out within the quoted timeframe, is there?No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -
Fermi has proffered a suggestion as to how to delay things beyond AD.

I just posted a thread on this as my partner is 6 weeks to AD, and JUST got an IPA to sign, but as its based on incorrect figures, he won't be signing. We will be replying within 7 days as requested but as it will have to recalculated and agreed I'm hoping they go over the date.
As for your point above, our elec is in red letter stage, we certainly are not in the happy position of paying it as soon as the bill arrives lol.
Also its good to see open mindiness here as to be honest, I was a bit scared of asking my questions simply due to some very judgemnental and almost 'looking for a fight' comments on some of the threads. We are not here to judge afterallLearn from yesterday, live for today, plan for tomorrow0 -

Regarding timescales, the area is a bit 'grey'. Whilst there are certain time allowances to return IPA forms etc, there is a general duty to inform the OR of a change of circumstances 'as soon as reasonably possible'.
Also I have seen the OR / Trustee apply to court for suspension of discharge if any forms or information is not forthcoming in time for AD (had this just 2 weeks ago actually).
I never had an issue with IS old guidance because if firstly reasonable needs are met within the allowances, then no IPA if there were less than £100pm surplus, then only take between 50 - 70% of the surplus is I would have though almost able to guarentee that reasonable domestic needs were afforded to the BR.
To take all monies spare after calculating expenses is draconian and does not in my opinion fit in to the spirit or the letter of the Insolvency Act. BR is a fresh start that should lead to a solvent future. Such action by the IS I feel is likely to force BR's back in to debt at unaffordable wonga.com type rates (4500%APR) when the washine machine breaks, the telly goes bang or some other emergency.
I also see nothing wrong with lawfully attempting to avoid or reduce an IPA.

This is another question I have posed before, regarding the reasons for suspending AD.
So really, given the current policy of the IS regarding IPA's, BR's need to actively consider and plan ahead if a surplus-based IPA is to be avoided?
This might involve, re-considering employment plans, or indeed, living arrangements?
Sadly BR's are being pushed into the same realms of avoidance that faced parents and the CSA? [ie, basic incomes for a period]
IPAs really need to now be queried at every turn............
Advice I would offer new BR's centres on one very important word!
