Ppi help needed

Hi,
I have been reading lot of posts regarding claiming PPI and was looking for a bit of advice before i started my claim.
I took out a credit card with Abbey/MBNA in 2002, which i cleared and closed in 2006. I have found the last statement and it has payment protection cover on it which i have never taken out with any finance as i have been employed in the same job for 22 years with a company that has a no compulsory redundancy policy, so it never seemed necessary.
The only details i have are the account number, i have no recollection of how i applied for the card other than it not being online as i had no access to PC then. Is it better that i contact the lender asking for terms and conditions of the card, or just complete the questionnaire with the details that i have and hope for the best. Im conscious of the time restraints involved so any advice would be much appreciated.
thanks
Marj

Hi there, all you need to make a reclaim is the card number from your statement.
Look here for reasons for mis sell and if any/all apply to you, plus the one you said her, then put a claim in.

If you have no proof of ppi from more than 6 years ago, then if you win they pay redress from the past 6 years.0 -

That is what everyone says until they suffer a claimable event and realise they did need it.
that wont help you.Is it better that i contact the lender asking for terms and conditions of the cardjust complete the questionnaire with the details that i have and hope for the best.
that is your best bet along with why you think it was mis-sold (which will be difficult as you cant remember).I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0 -

So, you seem to have taken out cover with the policy, without your knowledge in 2002. Lets suppose, for argument's sake, it was 31 December and there was no statement in January and you first statement was dated 28 February 2003. Suppose your last statement was dated 28 January 2006.
This makes the least number of statements you are likely to have received and comes to 36.
That is 36 monthly statements, each specifying a PPI premium.
Under the rules of the FSA, to force the provider to investigate you must complain within 6 years of when the event giving rise to the complaint took place (that seems to have been over 9½ years ago now) or within 3 years of when you knew, or ought reasonably to have known, you had cause for complaint.
I think the lender can reasonably argue that if you did not want the cover you should have raised the matter with them when you first got a statement.
So unless you have a persuasive argument why you did not know until now I think they can timebar it.
"I did not read my statements" would not constitute a "persuasive argument" because you "ought reasonably to have" read your statements and therefore would have identified the problem promptly.0 -
Hi there :j
Do you have an address for Abbey who you wrote to? I want to start pursuing a claim but don't know where to write to. I also know that the Abbey are now Santander. Any help would be appreciated.
Thank you and good luck with any ongoing claims you have
