Local council actions mean we need a damp proof course

Hi - on our house survey it states we need a damp proof course because the council have raised the height of the pavement too high. Can we sue the council for the damage and the cost of the damp proofing? Many thanks in advance for any recommendations.

In England yes, but I'm not sure what goes on up there

If it is a house you are buying, you may need your sellers to initiate action and take the action over on purchase.

or you get them to reduce the height of the pavement so that it doesn't bridge the existing DPC. Either way they would have to act.

I would be wary about trusting the report implicitly if it is a House Buyers Report. Don't forget the nature of the behemoth you will be taking on. I think a second qualified opinion is very necessary.

Walking away from it might seem a sensible option to consider too if you are that concerned.

    Cheers

Edit: Sorry - just noticed you might be north of thw wall. Dont think HBRs apply up there but I coild be wrong.
