Hello - just a bit of background - I wanted to buy some sort of cupboard/bookcase/something for my hall. I specified that whatever it was that it had to be no more than 35 cm deep.
I had a great deal of help from a shop (an independant trader) who helped me to go round the shop, measuring things and then came up with a brochure showing me a cabinet which was supposed to be 33cm deep. It looked ideal so I ordered and paid by credit card.
They had to order it so I collected it on Thursday from the shop. I commented at the time that it was wider than I expected but took it anyway as I thought that I might have been wrong.
As soon as I got it home I realised that it was far too wide for my hallway and rang the shop the next day. They said that the brochure measurements showed that it was 45 cm deep (which it is) and that they would speak to the salesman who dealt with me. Strangely enough (!) he cant remember discussing the width of the cabinet. He can however, remember discussing the different prices of different woods.
thinking that I was being reasonable I said that I could see that there could have been some misunderstanding about the measurements and I asked if that this cabinet could be swapped for something else.
They have told me that unless the manufacturer will take it back from them that they do not want to be stuck with it. I said neither did I as it did not fit in my house.
they are going to ring the manufacturer on Tuesday (if they remember - but they have already forgotten to ring me back twice)
I just wondered if there was anything that I could do to make sure that I could return it. I feel that I was quite clear when buying it that I made very clear that the depth of the furniture was the most important thing and the salesman showed me this cabinet in a brochure and assured me that it was the correct measurements. Its a bit of my word against his.
Does it make any difference that I paid by credit card? There is nothing wrong with the cabinet - its just not the size that I thought it was.
Can I insist that they take in back?
Any advice greatly appreciated - thanks

I am confused they showed you a brochure in which the cabinet was 35cm now they say the brochure has it as 45 cm. Did you not look at the brochure and check ?
If you can prove that the agreed size was 35cm and the delivered size was 45cm. You have a case to reject. If you cannot prove that was what was agreed, then you are dependent on the good will of the shop."The whole problem with the world is that fools and fanatics are always so certain of themselves, but wiser people so full of doubts."

No I didn't see the sizes in the brochure - he read them out and I looked at my tape measure..
I think that we probably both made a mistake. Me not for double checking and taking what he said at face value.0 -
was it width or depth? One minute your saying its far too wide then saying its 45cm deep.
I can see how the confusion would have happened in the store0 -
Hmmm - put like that I can imagine what has happened....Fancy that, a woman that can't do shopping:rotfl:0

If the manufacturer agree to take back the item they will more than likely levy a restocking fee and the retailer will be down on two-way postage fees.
If it is possible that both retailer and customer are jointly responsible then maybe agree/offer to pay costs? If you want to exchange the product for something else rather than refund then your also likely to get a better response from them.0
