iPod woes

I bought my son an iPod Classic last September for an Xmas present from Dixons Tax Free at Manchester Airport.
It's now started playing up, so I contacted Dixons by email. They advised taking it to an Apple store; my son did so yesterday in Manchester. They said they could fix it & to bring it in.
He did & they tried to claim it was outside the warranty period - 90 days! But he could trade it in against an upgrade for an extra £70.
Who's is wrong?
I think both - Dixons, because I bought it from them & therefore that's who the contract is with, and Apple, because the warranty should be 1 year.
I need to get this sorted, because the year will be up in 3 weeks time.
What's the best approach?
