Interest?

A question for anyone who has had long-standing arrears which have been paid following legal action. Did you achieve any interest payments on your arrears? I know it is possible, if a CCJ remains unpaid, to go back to court and get a further CCJ for interest on the debt. Is this something the CSA do when they obtain Liability Orders? Is it something they would do if I asked?

I am in discussion with my MP over charging and just wondered if there was any mileage in asking why interest isn't charged (if that's the case) on long-term arrears. If I'm going to have to pay for the CSA to provide me a service, might as well get every penny!

    I didn't - my arrears went back 8 years! Be interesting to find out why they don't go for it.
  • I didn't get any interest. My ex owed me four and a half years worth of payments by the time I received anything.

    I have no idea if interested has been added to what my ex owes, I didnt know if they did that, it is currently at just over £25,000.00. In 14 years we have never recieved a penny.

    You only get interest added on advance payments I'm afraid.

    I agree it's totally frustrating when arrears have accrued over a number of years for whatever reason and,if they are paid, the payments are spun out over years without interest added. I believe it would be an incentive for arrears to be paid quicker if interest was added.

    In the early days interest was added, but the govt stopped it.

    Once C-Mess phase 3 is in operation ( if it ever will be!) and we are charged for the privilege, I'm looking forward to launching a small claim action for breach of contract when it fails to deliver /maladminstration.

    I suspect our county courts will be in meltdown.

    Given people cannot sue the govt I would appreciate one of our CSA bods making enquiries into this, or, given the CSA read this MSE forum, they could contact one of our mods to clarify.

    I do hope the govt does away with the long drawn out complaints procedure which is specifically designed ( more so over the past couple of years) so their clients will give up.

My ex had a CCJ for £12k secured against what was our marital home - a year later, they got another CCJ for something in the region of £1.3k as interest...I presume that could have gone on for the forseeable, each year. So why aren't the CSA doing this?

    As for C-mess phase 3, I have a letter from Maria Miller to my MP stating it will open to new cases in 2012,with a phasing in period for the rest of us. I suspect all those on CSA1 have heard that one before!

The first cases to be closed (so they can be put on the future scheme) are the cases that are currently clerical - this is because it costs the Govt much more to run those than cases where everything works smoothly in CS2.

    My case is CSA2 and it's clerical!

    I have no idea why it's clerical except,for some unknown reason, the computer wouldn't accept it.

    The arrears would have been cleared last year, but because it was clerical arrears have arisen again because of human error. Naturally the CSA don't accept responsibility for their errors and the NRP is currently paying the arrears off at a rate that suits him but not me. My wishes are not taken into consideration.

    Have you any idea what the complaints procedure will be on C-Mess3?

    Not sure what the complaints procedure will be, I'd imagine it will be streamlined though.

    Yes it can be added as it was to mine, they suspended this when it got to Court and the Judge took them to bits, how sad never mind!

    You also have to remember that if the NRP is in the situation, that due to the current economic state of the country is not uncommon, and goes bankrupt then the interest can be covered in that, so it may not be payable in any event! So in my opinion the system may just for once work in the favor of the NRP!

    All this aside, if the system was run properly and the NRP not villainiesed and a system put in place that is seen by both sides to be fair, then in all probability most of these cases would not exist as the CSA would not be used as it is as a weapon by the PWC to get at the NRP as it is at this time, though not by all!
