Problems moving into rented house

Options
Just moved in and the place was left filthy, broken glass, broken furniture, mould in bathroom, rubbish inside and out, grease on every surface in the bathroom.

We spent three days scrubbing everything in our last house before we left.

The estate agents are managing and say they cant do anything until they get the inventory report back.

I don't understand why they haven't at least checked the property between tenancies themselves.


I feel really desperate! Help!

    Did you not view the property before you moved in?

    Did you have a inventory for the place done at the start of your tenancy?

    Did you give a deposit?

    Why did you accept the place in this state?

    There were people living in it so it wasn't like this when we moved in. Lots of broken furniture was hidden, like a wardrobe precariously balanced on a broken foot and a tv stand with the front of a (missing drawer) attached with a tiny bit of Velcro so when you pull it it comes off revealing nails sticking out!

    The previous tenants have obviously left it in a right state but it seems enormously unfair that we are now having to deal with it all.

    The inventory that was taken at the start - did you sign to accept it? Have you been given a copy? If you did, then you have accepted the condition of the property. You must NEVER sign anything without checking and verifying you agree with it. Regardless of whether anyone was living there, it is down to you to check, and you could have refused to sign the inventory until you could get into the property and see for yourself.

    Does the inventory just list all the fixtures and fittings in the property, or does it include the condition of each room, its carpets, walls etc? Does it say it was clean, freshly painted, un-damaged? What inventory are the agents waiting to be returned?

    You can dispute the condition of the property with the agents - write to them keeping a copy and ask them to come back to see the damaged furniture etc, but if you are now living there and have already changed the property's condition by cleaning and rectifying some of the dirt/damage, you may have little to prove your claims. As above, do you have photos etc?

    Inventory is very short and makes no mention of any furniture at all- I am just confirming that it is the full one.

    Says it has been cleaned to a 'good domestic standard'. We have taken loads of photos, and have sent a list of all the problems to the EA. No, we have NOT signed the inventory and won't until it is satisfactory!

  • I am going through the same thing. I decided not to pay the rent.
    Here's my story below:

    I moved in a home July 7th 2011. The home was spacious and kind of nice but needed some repairs from previous tenants. The property mngt owner said that all repairs were going to be made and house will be completely clean. For some reason she kept making it difficult to let me do the walk through after 5pm. Well I moved in and the house was a total disaster, Mold in shower ceiling painting faling down, carpet stains everywhere, patched walls and marks on every walls, wholes on closet door and off track. I sent her and email that week end when I moved in and she didn't reply untill the next monday saying that the home was clean and to her opinion the home was in perfect shape I made a list and she wasn't repairing anything. She came in my home with no notice and went through my belonging and paperwork. Garag door came off track and fell down on my husband which he ended up in the hospital.
    She didn't care, still none of the repairs were being taking care of. when rent came due on the 5th of august I decided to not the rent to get some kind of response and nothing at all. I actually saw that she listed my home for rent from the second of august. I wasn't even late yet on my rent!
    She filed for eviction and I asked for a hearing which is this coming monday.
    Does anyone can give some kind of advice. If I did not hgave 3 kids and school starting I would have moved but I don't have time to go through another move. I just want everything to be handled properly.
    I have emails and pictures to bring to the judge.

    Miab - are you in the US? I ask because some terms used in this and your previous posts which you have since deleted - $, closet etc, are not commonly used in the UK. Also, the time of your postings would suggest US time. If so, I do not think that there are many members here who are familiar enough with US laws and tenancy regulations to help you.
