If you dont remember then really you shouldn't put in a complaint.

starting with the NR policy - you have a genuine complaint that they continued to take the premiums despite you cancelling the cover. That (should be) an open and shut case for a return of the premiums paid since you cancelled.

You state that you only think that the cahoot loan would only "allow if you had ppi". If you complain they will say "no, you were given the option and you decided to take it".

On the complaint form will you say "i think i had to have it, but to be honest i cannot remember that far back" or will you say "i was told to have it to get the loan"?

If it's the former, it's your word against theirs and there are many years between the application and present day so the adjudicator at FOS (who will look at it on the balance of probabilities) will not find in your favour.

  • I successfully claimed my PPI back from an Egg loan, but they stated I had not paid PPI since 2006 on my credit card so were not obliged to follow up my complaint. I know I had the credit card from 2000 and paid ppi originally before cancelling it not because it was missold but because I couldn't afford it. Can Egg do this or should they be looking at my credit card prior to 2006. Any advice would be most grateful.
  • I paid off the credit card in 2009.

You could ask for a copy of the application form / agreement to check whether you signed for it. Some people didn't but it was added anyway.

But if you can't recall any other details of the sale, it will be difficult to prove whether it was missold. Some lenders may offer a refund as a "goodwill gesture" when there's an element of doubt, but others are rejecting them.

They will look at it again if you have statements showing ppi was paid before 2006,if you have not, then there is nothing you can do i am afraid.

True, hence the "if", but we don't know enough about the sale and what was said to persuade the customer to take them out. For example, if someone is told they "must" have the PPI sold by the bank in order to get the loan, but then discovers that was untrue, then surely they were still missold that particular policy even if they feel similar cover is valuable.

Strictly in these circumstances, there misleading statement would have been made but to be a missale them misleading statement must have led to a purchase that would not otherwise have been made.

Given that the OP replaced the original policy when they found they could get a cheaper alternative I think, on the balance of probability they would have purchased it anyway - even assuming that it was possible to demonstrate that a misleading statement had, in fact been made.

So I do not find the story I have read sufficiently persuasive to believe that a complaint should be upheld.
