Capital one PPI rejected

Hi all,I submitted a letter to claim on behalf of my BF to Capital one regarding his Credit Card PPI.I put in the letter that he was not told that the insurance was optional.The policy exclusions were not explained to him either before or at the time he took out the insurance. He was therefore unable to make an informed decision as to whether this insurance was appropriate for him.Their reply was....Your application was successful and we sent you your new credit card on 15 OCTOBER 2003 you called Capital One to activate your new card during this process the ppi was purchased.Initially PPI was not added as you ticked no on your postal application form.During a telephone convo you purchased the PPI and it was added to your account.You did not contact us to cancel the policy,so we assumed you were happy with it.This is our final response and have found no evidence of the policy being mis-sold and won't be refunding the money,if you wish to contact the FOS you can do so.
I'm new to all of this reclaiming and forum posting so I am a bit lost as now what he should do,If anyone can help i would be very grateful thnx :)

    Hi and welcome

    I understand going by also others who have made complaints against these that they do reject a lot.
    I would go now then complain to the FOS details below and on the form you complete with them tell them your reasons on why you believe it was mis sold, they will take a look at 2 sides and will take everything into consideration.
    Also if you feel you have missed anything add those details as well.

    Also,with regards the call when you activated the card (this is bull so they can sell you ppi) you felt pressured and you would like the recording of the conversation that took place as you dont believe you gladly accepted this ppi,also why would you tick no ppi,only then to take it after a call to activate the card? nothing changed in your circumstances between getting the card and activating it,this is a reason you felt you were pressured into taking it.

    If the bank says no, refer it to the Ombudsman - that's what they're for. Go for it and good luck :beer:

    Capital One told me they only keep call recordings for 12 months unless it is a sales call. If PPI was sold on this call then it must be a sales call so they should still have it. An email address they don't tend to give out is [EMAIL="executive_office_uk@capitalone.com"]executive_office_uk@capitalone.com[/EMAIL] and their direct line is 0115 8433792. According to customer services this number doesn't exist but eventually someone from the ERC dept gave it to me in a voicemail that was left for me.

    Can I ask if there has been any update on this?

    I have just received exact same wording in letter from Capital One.

    About to send to complaint FOS - fingers crossed!
