  • Unless your in a very complicated situation (pets, DSS etc.) you should be able to sort out a flat within 2 months but I understand being careful.

    Bad credit, partner is self employed and we've got a working dog that needs to come home to sleep.

    we've got characters references and a guarentour each and the dog's got a reference (plus he's not at home in the day) and i've got 2 viewings lined up for the weekend and another in the pipeline, i just don't want to hand in the notice and then be homeless!

    I completely understand in that situation. It's been a year and I am still looking for a house that will let me have a cat!

    Thanks, I'm confident we'll find somewhere, I just need to make sure we've got the savings in place to move quickly

    As for giving the notice when 6 months rolls around, take a careful look at the contract wording. It would be normal to be able to give notice with the termination date at 6 months, hence the notice being given at 4 months.

    they live abroad....does this have an effect?

    I am fairly sure it is a legal requirement for a UK landlord living overseas, to provide their tenant with a UK address for serving notice. Is there nothing in your tenancy agreement giving a third party address for such contact?

    It's says the address to send the notice to is their abroad address.

    This is illegal. You do not have to pay rent until you are given an address in Eng/Wales (not UK).

    Contact the LL by whatever means you have at whatever address you have, asking for an address in Eng?Wales. Refer to the Act below. Stop paying rent (put it to one side) until you get an address (You will then have to pay the back rent).

    S48 LL & Tenant Act 1987:

    48 Notification by landlord of address for service of notices.

    (1)A landlord of premises to which this Part applies shall by notice furnish the tenant with an address in England and Wales at which notices (including notices in proceedings) may be served on him by the tenant.

    (2)Where a landlord of any such premises fails to comply with subsection (1), any rent or service charge otherwise due from the tenant to the landlord shall (subject to subsection (3)) be treated for all purposes as not being due from the tenant to the landlord at any time before the landlord does comply with that subsection.

    Since your property is clearly not secure (someone has been in), change the barrel of your lock (£5?).

    In that case, legally you shouldn't even be paying rent, as under the Landlord & Tenant Act 1987 rent is not lawfully due unless the tenant has been given, in writing, an address in England and Wales at which notices can be served.

    That is not to say you shouldn't keep the rent aside and pay the LL at a later date.

    Sounds like your LL doesn't really understand their obligations. However, if someone has been in your property and LL is overseas - who has been in?
