    How this is a 'dispute'? I won't be going in heavy handed just stating that the issue has been pointed out to them.

    If they agree to remove the tree and roots and there is no damage then thats fine.

    If they dont agree then so be it it is a dispute, from what I have read they will be liable for any damage to my house.

    I'd rather have the 'agreement' formalised than be concerned that any foundation damage would be considered my negligence and therefore us liable.

    I dont think I am being precious or confrontational but covering my [EMAIL="a@se"]a@se[/EMAIL] incase the proverbial hits the fan.
