MBNA PPI claim

Hi

I have written to MBNA to reclaim PPI on my loan account. I wrote to them using Martin's template letter asking for the terms and conditions. However, MBNA have written back stating ' This loan account has in fact been paid in full, and so the account is closed with a nil balance. As such, by virtue of section 77(3)a section 77(1) does not apply'.

Can anyone advise if I can still claim or is this just a tactic to put me off reclaiming?

    Hi there

    You can still make a reclaim it makes no difference at all if the loan is settled or still running, I believe they are trying to say they do not have to send the copy of the agreement as they may not longer hold this as the account is closed and paid off.

    If you have your reasons and your account number then just continue to make a reclaim.

    All you do is complete the reclaim questionnare as on step 3 below, send to their head or complaints dept, keep a copy for yourself, they normally have 8 weeks, but may ask for more time if needed, as some have backlogs to get through.
