Estate Agent being difficult over refund

Hi

I wonder if anyone can offer any advice with my current issue?

I got hit with £125 of bank charges when the estate agent took my rent and deposit payment out twice by mistake. The company who they use (Sagepay) to make the payments sent me a letter confirming they would cover the charges.

SagePay had to give the money to the estate agency, who would then refund it to me- The estate agency have had the money since 16 July 11 but they keep fobbing me off with excuses as to why they can't give it to me- that the money was applied as a credit on their monthly bill so they don't actually have the funds to give me.

Where do I stand? My contact at the estate agent now ignores my emails and won't answer any calls from me. I've written to their Head Office but they don't reply either. if I want to take this further, who would I go to? The CAB? Or consult a lawyer?

I know its only £125 but thats a lot of money to me!

    What do the Estate Agents have to do with this? If this Sagepay have taken money from your account in error incurring you additional charges then it falls to them to refund those charges. Whatever arrangement they have with the Agents is immaterial to you. Write to Sagepay and title your letter 'notice before action'. Address it to whomever has written to you and invite them to place the funds into your account within 10 working days. ( I am assuming they have already returned the rent/deposit taken in error?).

    If they do not pursue them through the small claims court. This is a fairly painless process and you will get loads of advice here on how to do it. By introducing the Agent into this dynamic I get the impression they are trying to cloud the issue although they will work as agents of the agent.
