Hi everyone

I have been browsing for a few months regarding ppi. I am not sure if i am eligible to claim MSPPI. I would be grateful for any advice anyone can give me regarding the PPI.

This is really long so i appreciate your time reading this:

I took out my first credit card in August 2005, i had taken a year out to work and save up money and was due to go back to University in September 2005 to complete my final year. I was told at the time because it was my first time borrowing and i was going back to be a student that i would need PPI - i was told if i didnt take it i would be rejected and that there was no point in going ahead with the application as they would consider me to be a high risk without it and that it was a waste of both our time. He filled out all the paperwork and did not give me time read the TC just gave me a copy to read later and asked me to sign.

I felt i had no option to take the PPI as i wanted to improve my credit score so in future i could apply for a mortgage in the future.

In March 2010 i was contacted by Halifax several times offering a 0% deal and LOB transfer offers. I explained its not worth it as the ppi is far too much. The advisor said that he could take it off immediately as a gesture if i did the BT. He advised that i no longer needed it because my account was in really good condition. I was quite surprised by the fact that he could cancel it that easily, and was happy to do the transfer as a result.

I finally did the BT Jun 2010 and they took the PPI off my account
The credit card has a balance and is still active. It was only in March this year that i found out through MSE the PPI scam.

Since the original CC was taken out in August 2005, i had my card upgraded and lost / stolen twice so they had to close the accounts each time and set up a new one. I dont have the original CC account number and i only have statements starting from 2007 - 2010.

My questions are:

Can i claim for mis-sold ppi even though the PPI was cancelled in 2010 when i transferred a balance from another bank CC to the Halifax CC?

If so with the accounts closed whats the best way to approach the claim? do i ask for the original signed T&Cs or do i send SAR letter

If i claim the remaning balance on the CC, can they force me to pay the rest up immediately and close the account down, what are the implications?

I would appreciate any advice or comments re the above, i am really confused with what i should/shouldnt do.

Thanks again
Ruks

Hi there, and yes you can.

If so with the accounts closed whats the best way to approach the claim? do i ask for the original signed T&Cs or do i send SAR letter
Do you still have the account number? if so that will do fine, you can though request a SAR if you want copies of all data in relation of the account. I am not sure if they will provide a copy of the agreement on a settled account, as they state they are not obliged to if the account is settled, but they may do, if you just want a copy of the agreement you write a simple short letter, enclose a £1 cheque or postal order, and ask them to provide this to you by 12 days.
A SAR they have 40 calendar days.

If i claim the remaning balance on the CC, can they force me to pay the rest up immediately and close the account down, what are the implications?
They should not close down the account, but if there are any outstanding arrears, they may possibly award the refund towards these and anything remaining plus interest should be awarded directly to you, however every bank differs in how they refund the compensation.

I would appreciate any advice or comments re the above, i am really confused with what i should/shouldnt do.

If you just want to continue to make a reclaim - you can do so by just completing the reclaim questionnaire as on step 3 below, send to the head office or complaints office of whoever set up the account.
    Keep a copy for yourself.
They generally have 8 weeks, but may ask for more time if required.

Good luck and hope this helps.
