Playgroup breaching data protection act?

  • wow ok didnt expect it to start off such a debate. However its nice to see a debate on these threads that hasn't resorted to petty name calling!lol
    Anyway today I took my letter into the playgroup today to get the exact name of the person I needed to forward it to. The playworker wasnt there but I spoke to the playleader. She told me she was appalled and since she has spent the majority of the last year dealing with the admin side (thanks local council cuts) she hasnt seen any of this, although she has her own issues with this member of staff. She was glad I had brought it to their attention, and putting it into writing means it can be looked into further. She ended the conversation by saying when any staff sign a contract they also sign a stringent confidentiality agreement, where any information concerning children in their care, and their carers should never be passed to anyone outside of the workplace (unless of course there is a risk to that person, or others).
    Im not interested in receiving a letter of apology, or even hearing back. As far as Im concerned Ive done what I need to. The play leader told me all official complaints must be investigated, especially those which are upheld by a superior (so it will be investigated because the playleader backs my complaint and confirms its not just malicious slander!) Im happy with that. The playleader also said she has told the powers that be that she cannot be stuck in the office, she must be in the play room the majority of the time. Her job is to supervise the other staff, and to care for the children, not to file paperwork! She has hoped that this complaint will back that up. And thats all I ever hoped I could do by complaining. So that they could look into it and if needed,make some changes. I was asking if it was covered by Data Protection Act because I wanted my letter to be as informed and correct as possible, not because I was trying to bulk it up or make it sound more than it was. If she was breaching data protection, or her confidentialy contract, or just being a gossip, surely she needed to know what she was doing wrong, and what the possible repercussions of that!
