Barclays dont comply with first letter?

Hello

We rang up Barclays and got details of the last three loans we took out with them. We paid PPI on all of them so we composed this letter using the template provided here.

Here is the letter

Dear Sir or Madam,

Account numbers:

********
********
********

We are writing to request a copy of the credit agreement for the above account under sections 77−79 of the Consumer Credit Act 1974. We enclose payment for £3. We would also like to request a copy of the terms and conditions that were applicable to the above account at the time we took out my agreements as we no longer have a copy and would like to check some of the details.

Welook forward to a response within 12 working days.

Dear Miss F****


Thank you for your request for a copy of a credit agreement and financial statement. Our systems showw that there is no sum payable under the credit agreement and therefore there is no requirement for us to comply with your request.

    I take it the account is no longer active then?

    If you request a Full SAR, they must comply to that by 40 calendar day and send all data they still hold on the account going back to the last 6 years, some will still hold data from earlier years, this however you have to enclose £10 cheque or postal order, there is a SAR template letter below if you want to go this direction.

    However, you can still make a reclaim, if you still have the account numbers and know you were paying for ppi and mis sold.
    Do not worry about the paperwork as such.

    I do have the account numbers and yes they have all ended. I assumed the first template letter covered both open & closed accounts. So I'm stuck now as I dont really understand the SAR route (I'm investigating) and I dont know how to reply to their letter?

    Hi there, as DI said,you only need the account numbers and reasons for mis sell to put a claim in.

    Ring Barclays (have the reasons for mis sell ready) and you can do the complaint over the phone.

    Hi Geoff

    A SAR is if you want to request for copies of all paperwork in relation of the account, but I note you confirmed you have the account number, so that will do without the need of spending asking for paperwork.

    The letter you have received from them is just to confirm they have not got to oblige to sending the agreement out if the account is closed. So you do not have to respond to them about that letter, not unless you want to ask them to return the payment you made of £3.
    Also just to make you aware, when requesting for a copy of the agreement, the standard charge is generally that of a £1.

    What I would personally do is just continue to make a reclaim, amersall also left the links on how to do this as well above.

    Just complete the reclaim questionnaire, on step 3, keep a copy for yourself, and send to the complaints or head office of whoever sold you the account.
