Fence

What is the best way to find out which fence is yours in the back garden, as before we moved in the owner put a new fence on the right side.

The owner on the left side first mentioned about the fence when we moved in that she was thinking of changing the fence as it has seen better days.

I will have to find the deeds just to check but does anyone know another way to find out.

Thanks

Garcon

It could be none of them, some of them or all of them.

You need to remember that looking at the deeds will normally only tell you who is responsible for the BOUNDARY, which is different from the fence. On the plans on the deeds, if a letter 'T' is in your land adjacent to a boundary, then you are responsible for the boundary. Some deeds will expressly include a clause for maintaining a fence / hedge etc, but this is not normal.

Some people may put a fence up on all sides of their boundary, but the fence maybe on their land and therefore nothing to do with you. Its not uncommon to see 2 fences on one boundasry - one put up by each land owner.

The only thing to do is ask neighbours. They normally know who owns the fence (not the boundary). Some femces may have been put up by neighbours together so the fence is then jointly owned.
