Ok, so the manufacturer has discovered a fault with the evaporation trays. They were made out of material that was too thick and therefore the heat from the fridge motor wasn't reaching the water. The engineer came, removed the old tank, and installing a new one. He told me that they are doing it to everyones fridge with this model.
Now that the engineer has told me that it was a design fault (even though I dont have it in writing), do I have any claim for the water damage to my new kitchen?

    Thanks
    Dan

Yes, you should have a good chance of a claim against Indesit for the repair of your kitchen units.

You probably won't be able to claim for replacement of units which aren't damaged, even if they can't match them.

Worth a try - you've nothing to lose.

Write to them first and see what they say. Give them 14 days to reply and state this in your letter (ie a reasonable period of time). Send the letter Special Delivery.

Next step would depend on their reply. If they deny liability, send them a Letter Before Action, advising that you will be commencing a claim in the County Court. Again, give them 14 days to respond. Then start a Claim.

Then I believe it is B&Q you should be dealing with as your contract is with them. Good for the credit part though :D Under Consumer Credit Act, they are jointly liable and you have the same rights with them as you have with the retailer.

If the Indesit engineer would put what he said (that its an inherent fault) in writing, it would help you greatly. Take pictures of the damage and obtain a few quotes to get an idea of how much it would cost to fix.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
