PPI and Sickness

Hi all
First post! I really need some pointers here. This morning I had a letter from RBS to point out they may have mis sold or note made clear conditions in insurance on my preference account. First question - what insurance?
My reason for this question is that in 2009, I became very unwell quickly and was signed off work for a period of some 3 months. I really panicked as I was not going to receive sick pay. I had been earning a really good salary of around £1600 a month so could easily manage my repayments. However, illness turned it all upside down so I reached for the phone and called thinking, great I have insurance for this, paid for years and no claim. I flatly got told my condition did not qualify. Its classed as chronic. However, there is no evidence to suggest that my condition is definitely chronic, stress fuelled and exacerbated it a lot over finances. I ended up reduced to stricly 16 hours a week on medical grounds and dropped salary of £1000 a month which threw me into financial crisis. I didn't bury my head, I phoned and kept creditors informed and now have an arrangement of reduced payments. Black Horse have not stopped my interest however so that account is going nowhere fast!
Long story short, i'm determined not to let my illness beat me and i'm trying to start my own business from scratch with no credit rating and no money behind me so I can work from home and grow again. I'm a doer and I promised in writing to creditors I would not neglect what I owed.
So my question is, am I entitled to make a claim if my insurance was unclear to me. And more recently, am I entitled to take the issue up with RBS as to why I now have insurance which I would never agree again after the last fiasco! Where do I start?

Sorry, your first paragraph said what insurance, then second paragraph said you had a claim declined, so you were aware that you had insurance.
Have a claim declined is not a reason for a PPI mis-sale. You said it was stress fueled, but most PPI policies wont cover stress related illnesses. Was it a pre-existing when you took the PPI?
You could argue that they didnt give you sufficient information, so did they supply you with information when you took it out?
They should of issued you with clear policy documentation which states what conditions will or will not be covered. The adviser/ sales person would have no obligation to go through every single exclusion when you took it out.0 -
roonaldo is right your whole point seems contradicting, first you ask what insurance, then say that you had a claim turned down.
If you knew that you had insurance, you should have a look at the reclaim section 3 for reasons of mis-sale and if you think you have been mis-sold, then fill in the FOS consumer questionnaire and send it off to your bank/lenders/credit card's head office, use the address from the letter you got.
They obviously think there may have been a chance you have been mis-sold as they have been instructed by the FSA if there has been a particular systemic paterns in mis-selling, so that they can then identify customers who may have been mis-sold, however, you need to go back to them with your reason's whether it's lack of information supplied to you at the time, or disclosing full details.

Hi, firstly well done on not burying your head in the sand - its just not worth it. Secondly, I would strongly advise you (I know because I have a similar claim on going) to keep going on this. Be really tenacious and if you feel that you have a rightful claim then dont be fobbed off by your attempts so far. Why have you still got the insurance then? Especially as you cant afford it and especially as they are not obviously forthcoming with claim payouts when needed. Supposing you get really ill again in the next few months - are they going to decline that on some wordage like chronic or acute even?? Who knows with insurance how they can wriggle out of claims. However, the upshot is that you had a PPI with your account. You became ill. You claimed. They refused your claim but acknowledged that you could have been missold the PPI. The ball is in their court. Keep going and get your finances back on track...
